Issues: • Existing Regulations: <br /> —The zoning ordinance considers antennas owned by telecommunication <br /> companies to be accessory uses in the MR-3, C-2, and I districts. The <br /> antenna must be located on the roof top, cannot contain advertising, and is a • <br /> conditional use if it's over 10 feet. <br /> —Amateur radio towers are limited to a height of 70 feet and must be <br /> located in the rear yard. <br /> —Satellite dishes are treated like accessory buildings unless they're on a <br /> roof top. They must be in the rear yard or on a roof top. <br /> —Towers owned and operated by telecommunications companies are not <br /> conceived of or addressed by the ordinance. <br /> • Purpose of Proposed Ordinance: <br /> —Provisions to protect the health, safety and welfare of the community <br /> while providing for a well designed and efficient communications system. <br /> Minimiw.adverse visual effects, avoid potential damage to adjacent <br /> properties, maximize the use of existing towers and buildings. <br /> • Location for Towers and Antennas: <br /> --Antennas permitted as accessory uses in the MR-3, C-1, C-2, C-3, and I <br /> districts if no higher than 10 feet; conditional use if over 10 feet. <br /> —Antennas permitted as accessory uses with approval from the Community <br /> Development Director in a PUD; amend PUD plan if over 10 feet. <br /> —Antennas permitted as accessory uses in the R district if church(if <br /> camouflaged), park, government, school, utility or institutional site; <br /> conditional use if over 10 feet. <br /> —Towers as conditional uses in C-2, C-3 and I districts <br /> —Towers as conditional uses in the R district if church(if camouflaged), <br /> park, government, school, utility or institutional site . <br /> • Performance Standards for Towers: <br /> —Setbacks in the C-2, C-3 and I districts the same as setbacks for an <br /> accessory structure(front=35', rear=8', interior side=3', streetside=25'). <br /> Setbacks in the R district same as setbacks for a principal structure (40', <br /> 10', 10', 30'). <br /> —Additional setback from residential use of 1.5 times the height of the <br /> tower. <br /> —The Council may reduce the setback to allow integration into an existing <br /> structure such as a church steeple. <br /> —Allowed only in the rear yard <br /> —Maximum height of 150' <br /> —No signage <br /> — No lighting unless required by FAA or if the tower is designed to be a <br /> light fixture. <br /> —Neutral color(except when required by the FAA) <br /> —Monopole design unless exception given by the Council <br /> • Co-location <br /> —New towers over 75 feet must be designed to accommodate one additional <br /> user(unless height restriction by FAA). <br /> —Applications for new towers must show why service can't be provided on <br /> an existing building or tower within a one mile radius of the proposed <br /> location. <br /> —The Council must find one or more of the following reasons for the <br /> 1111 <br /> company not using an existing structures unwillingness of structure/tower <br /> owner, would exceed structural capacity of existing structure, frequency <br /> interference, performance or system capacity would be affected. <br />
