I am <br /> happy to provide the additional information requested in your September 4 <br /> letter to explain how I feel I meet the criteria in the Zoning Code. <br /> I believe a variance should be granted to allow me to construct a three- <br /> season porch in the same location ascan existing deck. The following <br /> circumstances, cited in the Criteria for Approval of Variances, will impose <br /> an undue hardship, as well as practical difficulties, to me and my family <br /> in the future use and enjoyment of our home and property. <br /> a. The size and shape of my lot is quite different from other properties <br /> in the vicinity. My lot is of an irregular size which does not have the <br /> required rear property line set-hack. At the time my home was built in 1977, <br /> the zoning codes were different than they; are today. I was allowed to build <br /> my home, with a deck, with a shorter rear property line setback. As the <br /> zoning codes are written today, I would have practical difficulties with • <br /> construction of anything that I would do at the rear of my property, <br /> including replacing an existing deck. <br /> b.' My family and I would be deprived of the rights commonly enjoyed by <br /> our neighbors--the enjoyment of a three-season porch such as many of my <br /> neighbors now enjoy. <br /> c. The lack of the required rear property line setback does not result <br /> from my own actions, but rather from the zoning codes that were in existence <br /> when I purchased the lot and built my home and the irregular shape of the <br /> lot. I chose the lot because I found it a pleasant location and did not <br /> - - - -='• -. '_ "••• • - •' - W4' •-come a •e iment to <br /> future plans. <br /> d. Granting this variance will not allow me any special privileges <br /> as many of my neighbors have three-season porches and/or large decks. <br /> e. I assure you that should this variance be granted, it would be the <br /> minimum variance allowed to construct the three-season porch. No further <br /> encroachment, other than that required, would be requested. This is <br /> not a matter of economic hardship, but rather the hardship of not being <br /> able to enjoy a portion of our home and property. <br /> III <br />
