Let�er from the Applicant <br />'4�lHEREAS, the Pianning Cornmission does her-eby make the following findings of fac� <br />regarding the requirements for granting variances as set forth in Section 1125.02, 5ubd. � of the <br />Mounds �liew �oning Code: <br />a. ExceptionaI or extraordinary circumsEances apply to the property which do nat apply <br />generally to other properties in the same zone or vicinity and resnit from lot size or shape, <br />topography or other circumstances over whici� the owners of the properiy since the effectiv� <br />date hereof have %ad no control. ' <br />c. That the special conditions or circwmstances do not result from the actions of the <br />applicant <br />This site is heavily wooded, a portion of which lies in wetland. While #here is ample room <br />to pravide the full amount of parking required by ibe Zoning Code, the applicant would <br />prefer to retain muc� of the tree caver and keep the site as natural as possible. Research <br />has shown that the Mounds View paricing requirements are muc� higher in comparison to <br />neighboring communities and communities across the counfiry. The applicani is not <br />respor�sible for the City'"s parking requirements. It is advantageous io retain natural areas as <br />opposed to paving them for parking lots, if the parking provided will be adequate for the <br />use proposed. <br />b. The literal intezpretation of the provisions of tIus Title would deprive the applicant <br />of righis comm,only enjoyed by other properties in the same district under the texms of t�is titte. <br />d. Th�at granting the varianee requested will not confer on the applieant any speciai <br />privilege that is denied by this title to owners of other lands, slrucEures or <br />buildings in the same district. <br />The higher-than-norrnal parking requirements for offce and warehouse square footage <br />creates an undue burd�n on the applicant, and similar considerafi�on would be given to <br />other requests from developers who are proposing to build similar facilities. The <br />developnnent to ihe south, the Bridges Technotogy Center, was granted a similar parking <br />variance in 1995. <br />
