At the time of your last meeting, it <br />was sta.�s understanding ihat th� oniy Code violation on the rnodei homes was that they were <br />missin� the s�condary sta.ircases. This has since been resolved. We ar� now aware, however, ihai <br />the staircases and entrance platforms at the primary enirance are no� in compleie compliance with <br />the Code in terins of the handrails and ihe height and width of the steps. This has been an ongoing <br />problem with no� only the model homes but other homes in the park, In the past, there has been <br />somewhat sporadic enforcement on this item due to workload. We have started enforcing ihis <br />provision, but consider ii to be larg�r issue than just the model homes. It is staff's pre%rence to <br />address the existing staircases through an overall approach to enforc�ment in Colonial �Iillage, or <br />to provide a iune frame for the model homes to be broughi i�to compiiance. <br />The con�ingencies on the orig�nal CUP have been meti as %llows; Th� f rst required that ih� CUI' <br />be recorded with Ramsey Couniry, �which has been verified. �'he second contingency required that <br />the number of units available nat exceed six percent of licensed lots. There are currently 194 lots <br />within Colonial �Iillage, of which only three are model homes (refer to the site plan.) Tlus <br />represents a percen�age of less than two perceni. The third eontingency required that the mod�I <br />homes be insta.11ed in complianc� with all City and State regulations. An inspection by �iick Jarson <br />on Febnaary 28, 1997 verified that ihe secondary sta.ircases have been added as reques�ed. (Another <br />code compliarice issue is noted earlier in this report.) The fourth requirement states that the Ciiy be <br />seni a list of homes offered for sa1e, updated every month. 'The City has these notices on file, <br />indicating that this requirement has been met. The fifth requirement puts limits on the hours of <br />walk�throughs. Carol Mueller, ihe pa.ric manager, responds ihat they adhere to tkese hours. Staff <br />has not received any complaints stating o#herwise. The last requirement specifies that the CUP be <br />reviewed after one year. <br />Stiaff' is unaware of any problems associated with the CUP and does not have any documented <br />complaints regarding Coionial V'illage or its display and saies of znodel homes on file.
