This infoamaiion should be �vailable <br />prior to the Apri12, I997 Planning Commissian meeting. <br />Drainage 1'lar�: <br />From the con�ours on the site plan da.ted 3/14/97, the current drainage and vvater run-offflows <br />primarily into the wetland with lesser amounts flowin� into the Highway 10 ditch. Two N�URP <br />ponds are proposed on �he site alihough no caIculations have been provided to detemune the <br />e�pecied drainage volur�e nor capacity of the ponds. 5taff° has requested a more detaiied drainage <br />ari$.IySiS �TOri7 til� ���]1Cc�11t, in order to refer it to the Ciry Engineer. <br />Nafural Fecataares ana' Open Spr�ce: <br />This proposed development would replace whai is now vacant Iand with comtnercial and residential <br />uses, preserving ihe wettand fhai is present on this site. The r�aetland itself will nat be aliered in any <br />way as a result aithis project. Nluch of ihe site is cavered °ui prairie-t�pe grasses and scrub trees, <br />although there are a number of significant trees as well. The dev�lop�r has incorporaYed many of <br />the significantc trees into the design and landscaping of the project. �taffhas suggested installation <br />of a walkin� path around the weiland in addition ta the observation boardwall�/nature overlook <br />shown on the site plan e�rtending into the wetland. Any work within the wetland would require <br />permission from both �linnesota DNR and Rice Creek Wa�ershed District. No construction is <br />anticipated to occur vaithin the wetlarid, although there has been disc�assion about cleam-up worlc in <br />order io erthance the wetland. <br />Park Dedicataon Requirements: <br />T'he applicant will need to provide a park dedicaiion payment in an amount ta be established prior <br />io City Council �pproval of this PUD. Park dedication fees are based upon the fee schedule <br />pravided in 3ection 1204.02, Subd 4 of the Subdivision Code. The fee �or the residentia.l <br />component is 10 percent of the land value given the ratio of 10.3 residential uniis per acre, i�ss the <br />wetiand acreage. The wetlar�d covers an area or approximately 4.5 acres. The fee for the <br />commeccial and office uses ar� also based upon 10 perceni of the land value. The Pa�ks and <br />Recreation Commission will deternvne the exact dollar amount of the park dedication fee. <br />Provision for Common Qpen Space: <br />The site plan does not indicate any provision for common open space. The Zaning Code in Section <br />1120.04, Subd. 3f pertaining to Planned Unit developments, estabiishes criteria for PLTD approvai, <br />ane af which is that a sufficient amount of "usable" open space is provided. Section 1 I20.02, <br />Subd. 3, General Requ�rements and �tandards, requires that enough common open space to meet <br />the minimurn requiretr�ents of ihe Chapter is provided. However interprefiatiot� oi Section 1120.Q2, <br />Subd. 5, pertaining �o the stap,ing of open spac�, would indicate that peovision of common open <br />space is at besi optional. Yt states, "When a PUD provides for cor�t�rton open space ..." Nowhere <br />in Chapier 1120 af the City Code is tliere a defined requirement for common open space. Sta#� <br />recogruzes thai the Code is clear in that a sufficient amotant ofusable open space should be <br />provided with 1'ilDs but seeks the Planning Commission's input as to haw much should be <br />_ provided. <br />
