MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 56-82 <br />• CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING THE CONDITIONAL USE <br />PERMIT REQUEST AND DEVELOPMENT PROPOSAL OF <br />WAYNE HERR CONSTRUCTION COMPANY <br />WHEREAS, the applicant, Wayne Herr, has requested to construct <br />four 8 -unit condominium buildings at a site located at 2908 Highway <br />10; and <br />WHEREAS, the applicant is requesting Development Stage <br />approval for this project under the Planned, Unit Development Chapter <br />of the Zoning Code; and <br />WHEREAS, per existing Zoning Code, a conditional use permit <br />is required for residential P.U.D. projects; and <br />WHEREAS, the Planned Unit Development is intended to intro- <br />duce flexibility of site design and architecture for conservation <br />of land and open space through clustering of building and activities <br />through conditional use provisions; and <br />•WHEREAS, the site plan submitted meets minimum zoning and <br />planned unit development zoning requirements; and <br />WHEREAS, the development is consistant with the existing <br />zoning for the property, R-4, High Density Residential; and <br />WHEREAS, condominium developments are allowed in an R-4, High <br />Density Residential District; <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning <br />Commission recommends approval of the conditional use permit request <br />under the Residential P.U.D. chapter of the Zoning Code provided that: <br />1). An open space buffer be maintained between the southern- <br />most condominium unit and the R-1, Single Family Resi- <br />dential Area. Such open space shall be no less than <br />156 feet from north to south. <br />2) The full 25 foot roadway width be maintained during <br />all seasons for emergency vehicle access on all streets <br />within this development including the 25 foot road <br />easement to the south of this property. <br />3) The design of the knock down barrier be submitted and <br />approved by the Fire Chief prior to conditional use <br />• permit final approval. <br />4) A landscape plan shall be submitted to conform with <br />Chapter 40.22, Subdivision B(10). <br />
