MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 79-83 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION RECOMMENDING APPROVAL FOR MR. DONUT FOR A <br />CONDITIONAL USE PERMIT, MINOR SUBDIVISION, <br />AND DEVELOPMENT AGREEMENT EXECUTION <br />WHEREAS, the Mounds View Planning Commission adopted <br />Resolution No. 11-81 on April 1, 1981, recommending approval of a <br />conditional use permit, minor subdivision and development agreement <br />execution for a Mr. Donut establishment at Highway 10 and County <br />Road H-2; and <br />WHEREAS, on April 27, 1981, the Mounds View City Council <br />approved Development Agreement No. 81-41 which approved the conditional <br />use permit, the minor subdivision and the site plan; and <br />WHEREAS, the development agreement was never executed by the <br />developer; and <br />• WHEREAS, Scott Builders, the developer, is resubmitting his <br />fees and application with reV4 sons to the Planning Commission and <br />City Council for approval at this time; and <br />WHEREAS, the Mounds View Planning Commission has reviewed <br />this revised request from Scott Builders and provisions of the Mounds <br />View Municipal Code pertaining to conditional use permits, minor <br />subdivisions and development agreements; <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning <br />Commission recommends to the City Council approval of the following: <br />1) A conditional use permit be granted to include a <br />provision whereby joint parking covenents be filed <br />and recorded at the Ramsey County Court House between <br />Brooks Superette and Mr. Donut. <br />2) Minor subdivision be granted to include the following <br />provisions: <br />a) Drainage easements to be recorded for the ponding <br />requirements of Chapter 49A. <br />b) Utility easement for Brooks Superette be granted <br />• at the time they are located or relocated. <br />
