Subd. 6—Garages exceeding 864 square feet require a conditional use <br /> . permit. <br /> • Section 1125.01, Subd. f—Lapse of Conditional Use Permit by Nonuse: If the work for <br /> which the CUP was approved has not been completed within one year, the CUP shall <br /> become null and void unless an extension is filed beforehand. <br /> • Section 1125.01. Subd, le—Adverse Effects: The Planning Commission shall consider <br /> possible adverse effects of the proposed conditional use. <br /> • Section 1125.01. Subd. 3b—Criteria for granting of conditional use permits. <br /> Background: <br /> The applicant, Anthony Honkomp, has reapplied for the conditional use permit originally issued in <br /> April, 1995, and amended in November, 1995. This CUP originally allowed for the construction of <br /> an oversized garage as part of the applicant's proposed home at 2908 Ardan Avenue. Section <br /> 1106.04, Subdivision 6 of the Municipal Code requires a conditional use permit for all garages in <br /> excess of 864 square feet. The City Council adopted Resolution No. 4878 on January 22, 1996 <br /> approving a CUP that allowed a 994 square-foot garage. The CUP expired on January 22, 1997 <br /> because the structure has not been completed and the applicant did not file for an extension. <br /> Since your last meeting on April 16, 1997, the exterior framing of the house and garage has been <br /> completed. <br />
