rt <br /> • Planning Commission Resolution 511-97 <br /> June 18, 1997 <br /> Page 2 <br /> businesses along Highway 10 and meets the the intent of the City's sign code; and, <br /> WHEREAS, the variance requested is the minimum variance which would alleviate the <br /> hardship in that the sight-lines from passing motorists are greatly improved at a five foot setback <br /> from the property line; and, <br /> WHEREAS, the variance would not be materially detrimental to the purpose of this Title <br /> or to other properties in the same zone in that the right-of-way for Highway 10 is wider than <br /> normal, creating a larger buffer area between the paved roadway and the propety line. The visual <br /> setback is 70 feet; and, <br /> • <br /> WHEREAS, the proposed variance will not impair an adequate supply of light and air to <br /> adjacent property or substantially increase the congestion of the public streets or increase the <br /> danger of fire or endanger the public safety or substantially diminish or impair property values <br /> within the neighborhood in that the sign will be located approximately 70 feet from the Highway <br /> 10 pavement and should not cause any detrimental impacts to motorists or neighboring property <br /> owners. <br /> NOW, THEREFORE, BE IT RESOLVED, that the Mounds View Planning Commission <br /> 41 acting as the Board of Adjustment and Appeals approves the variance request of Ron Ostrander, <br /> representing Spot's Quik Lube, Inc. located at 2975 Highway 10 to allow a reduction in the <br /> setback requirement for the proposed pylon sign from 15 feet to 5 feet. <br /> Adopted this 18th day of June, 1997 <br /> Jerry Peterson, Chairman <br /> ATTEST <br /> Pamela Sheldon, <br /> Community Development Director <br /> (SEAL) <br /> N:\DATA\USERSTAMS\SHARE\DEVCASES\488-97\SPOTS-RE.W PD <br /> • <br />
