Subd. 2: Criteria for granting variances. <br /> • Attachments: Planning Application <br /> Zoning Map <br /> Site Plan <br /> Letter from Applicant <br /> Planning Commission Resolution No. 518-97 <br /> Background: <br /> Annette Katzmarek is requesting a variance to locate a 96 square foot shed in her side yard against <br /> her house at 7730 Edgewood Drive. The applicant is a day care provider and feels that locating <br /> the shed outside of the fenced-in backyard would be the best location due to safety and <br /> topographical considerations. At the proposed location, the shed would be partially screened from <br /> view by the extension of the garage area from the house. The site plan noting the proposed <br /> location of the shed is attached to this report. <br /> Analysis: <br /> According to Section 1106.03, Subd. 1, all detached accessory buildings are to maintain a six-foot <br /> setback from any other structure. The intent of this Code is to maintain a uniform separation of <br /> buildings for purposes of fire prevention. While there are previous instances of accessory buildings <br /> adjacent to principal structures, in each case it has been required that adequate fire retardant <br /> materials be installed as deemed necessary by the City's building inspector. <br /> • The applicant feels that this location is the most appropriate because of three considerations. The <br /> back yard of the property slopes down away from the house, creating a situation whereby a level <br /> surface would need to be graded for the shed.
