Silver Lake Commons Minor Subdivision Request <br /> Meeting Date: September 17, 1997 <br /> Page 2 <br /> • <br /> Park Dedication Requirements: <br /> Section 1204.02 of the Mounds View Municipal Code requires that any subdivider of land shall <br /> either dedicate land or make a payment to the City for park dedication purposes in an amount set <br /> forth by the Code. For residential developments, this fee is based on gross density, or in other <br /> words, dwelling units per acre. For developments having gross densities in excess of 5 dwelling <br /> units per acre, the fee is an amount equal to ten percent of the fair market value of the land being <br /> subdivided. Since an appraisal of the vacant lot has not been accomplished, staff and the applicant <br /> proposes to substitute the actual purchase price for the lots, which is $75,000. Using this figure, <br /> the appropriate park dedication fee would be $7,500. Staff will require that this fee be paid prior <br /> to building permits being obtained for this development. <br /> Easements: <br /> Staff has requested that easements be dedicated for drainage and utility purposes on the combined <br /> lot along the property lines. Ten feet will be required along the front and rear property lines and <br /> five feet for the side property lines, which are shown on the Certificate of Survey. These <br /> easements shall be executed by means of a document to be recorded with Ramsey County prior to <br /> the Mayor's and the City Administrator's signatures on the Certificate of Survey. In addition, a <br /> shared access driveway easement will need to be executed prior to City Council action on this <br /> 11111 <br /> minor subdivision. Upon approval of this request, the shared access driveway easement shall be <br /> recorded with Ramsey County. This easement will guarantee vehicle access to the apartment <br /> buildings via the access from the townhome parcel. <br /> Changes to Survey: <br /> At the Planning Commission's last meeting on September 3, 1997, staff requested that the <br /> Certificate of Survey be amended to reflect the addition of three things: (1)the title "Certificate <br /> of Survey, "(2) a signature block bearing the names of the Mayor, Duane McCarty, and City <br /> Administrator, Charles Whiting; in addition to the name(s) of the property owners of the <br /> development shall be added to the survey, and (3) a block of text regarding the drainage and <br /> utility easement. This has all been accomplished with the exception of a place for the owners of <br /> the property to sign on the certificate of survey. This will need to be done prior to Council action <br /> of this request. <br /> Recommendation: <br /> Staff recommends that the Planning Commission approve Resolution 529-97, a resolution <br /> recommending approval of a minor subdivision request of MSP Real Estate to combine the two <br /> vacant parcels south of the apartments into one lot, provided staff has resolved the two issues <br /> described above, subject to stipulations. <br /> N:\DATA\GROUPS\COMDEV\DEVCASES\5049TMINOR PC.RPT <br />
