REQUEST FOR PLANNING COMMISSION ACTION <br /> Meeting Date: January 7, 1998 <br /> Staff Report by: James Ericson, Planning Associate <br /> Planning Case No.: 511-98 <br /> Request: The applicant is requesting a Conditional Use Permit to allow for <br /> outdoor plant and flower sales at Moundsview Square Shopping <br /> Center. <br /> Petitioner: Peter Linder, representing Linder's Greenhouses, Inc. <br /> Location: 2535-2585 Highway 10 (Moundsview Square Shopping Center) <br /> PIN No. 30-23-07-11-0079 <br /> Zoning/Land Use: B-4, Regional Business District/ Shopping Center <br /> Applicable Regulations: <br /> • Section 1115.04, Subd. 2 of the Mounds View Municipal Code states that"Open or <br /> 11) outdoor service, sale and rental as an accessory use" is a conditional use in the B-4 zoning <br /> district, requiring a CUP to be obtained. <br /> Section 1125.01, Subd. 3b of the Code states that"in granting a conditional use permit, <br /> the City Council shall consider the advice and recommendation of the Planning and Zoning <br /> Commission and the effect of the proposed use on the Comprehensive Plan and upon the <br /> health, safety and general welfare of occupants of surrounding lands" and shall make the <br /> following applicable findings: <br /> • The use will be sufficiently separated from residentially-zoned land. <br /> • The use is reasonably related to the overall needs of the City. <br /> • The use is consistent with the purposes of the Zoning Code. <br /> • • The use is not in conflict with the Comprehensive Plan. <br /> • The use will not create traffic hazards or congestion. <br /> Attachments: Planning Application <br /> Location Map <br /> Site Plan <br /> Greenhouse Design <br /> Interior Specifications <br /> Letter from Applicant <br /> 110 Letter from Property Owner <br /> Resolution 534-98 <br />
