Would maintain a separation between the existing residential and commercial uses <br /> 3. Would not increase traffic on Mounds View Drive <br /> 4. Would not require intensive lighting <br /> 5. Would be aesthetically pleasing from an architectural perspective <br /> The rezoning would also be consistent with the comprehensive plan in that it addresses Goal#3 of <br /> the Residential goals and policies section of the plan, which addresses the provision of housing to <br /> meet the needs of all segments of the population, notably groups with specialized housing needs, <br /> such as the elderly. <br /> CUP Discussion: <br /> The proposed use addresses a specialized and unique niche in the elderly and infirm care industry, <br /> the likes of which are not evident in this immediate area. The conditions of the use, according to <br /> Section 1109.04, Subdivision 2, are as follows: <br /> a. Side yards double the minimum requirements established for this District and are <br /> screened in compliance with Section 1103.08 of this Title. <br /> b. Minimum lot area shall be no less than one (1) acre, or as provided in Section 1104.02, <br /> subdivision 2b(3). (Ord 590, 11-29-96) <br /> c. Only the rear yard shall be used for play or recreational area. Said area shall be1111111 <br /> fenced and controlled and screened in compliance with Section 1003.08 of this Title. <br /> d The site shall be served by an arterial or collector street of sufficient capacity to <br /> accommodate traffic which will be generated <br /> e. All signing and informational or visual communication devices shall be in compliance <br /> with the Mounds View Sign Code <br /> f All State laws and statutes governing such use are strictly adhered to, and all required <br /> operating permits are secured <br /> g. One off-street loading space in compliance with Chapter 1122 of this Title is provided <br /> h. The provisions of Section 1125.01, subdivision le of this Title are considered and • <br /> satisfactorily met. (Ord 590, 11-25-96) <br /> The applicant has been apprised of these conditions and has indicated to staff that they can be <br /> satisfied. The last condition, Item H, pertains to the adverse effects associate or resulting from this <br /> use. The Planning Commission and Council are to consider any possible adverse effects in its <br /> decision. Those listed in the referenced code are included as follows: <br /> (1) Relationship to Municipal Comprehensive Plan. <br /> (2) The geographical area involved. <br /> (3) Whether such use will tend to or actually depreciate the area in which it is proposed. • <br /> (4) The character of the surrounding area, <br /> (5) The demonstrated need for such use. <br />
