4 <br /> REQUEST FOR PLANNING COMMISSION ACTION <br /> • <br /> Meeting Date: September 15, 1999 <br /> Staff Report by: James Ericson, Planning Associate <br /> Planning Case No.: 570-99 <br /> Applicant: Jeff Johnson <br /> Request: The applicant is seeking a variance for a zero-foot setback to <br /> construct a six-stall garage to service the two four-plexes he owns. <br /> Location: 2075 & 2081 Hillview Road <br /> PIN Nos. 05-30-23-41-0011 & 005-30-23-41-0005 <br /> Zoning/Land Use: R-3, Medium Density Residential <br /> Applicable Regulations: <br /> 1104.01, Subd. 4: Accessory buildings detached from principal building shall have a side-yard <br /> setback of five feet. Accessory buildings shall not be allowed in the front yard. <br /> • Attachments: <br /> 1. Planning Application <br /> 2. Zoning Map <br /> 3. Location Map <br /> 4. Site Plan <br /> 5. County Lot Combination Form <br /> Background: <br /> The-applicant, o w contiguous properties on rfiillview Road, each improved with four- <br /> unit multi-family structures, wishes to construct a six-stall garage structure between the two <br /> buildings to service both buildings. The problem with this request is (1) the structure would cross <br /> a property line, and (2) if approved, what would happen at some point in the future if one of the <br /> properties were sold. The applicant, since taking over ownership of these two properties, has <br /> invested considerable expense in rehabbing the buildings and making upgrades and improvements. <br /> The addition of a garage structure would without question be beneficial to the property, to its <br /> residents, and to the immediate area. <br /> Analysis: <br /> Addressing the first issue of a structure"straddling" a lot line, so to speak, one can look at Section <br /> • <br />
