Mounds View City Council September 12, 2005 <br />Regular Meeting Page 5 <br /> <br />along a wetland, it may result in more water in the wetland. 1 <br /> 2 <br />Mr. Rudy stated their concern deals with purged waters which can result in someone else a block 3 <br />away getting flooded. 4 <br /> 5 <br />Mayor Marty asked Staff to place discussion of a tree ordinance on the next Work Session 6 <br />agenda. 7 <br /> 8 <br />Director Ericson stated the City’s wetland regulations could be interpreted to prevent tree 9 <br />removal from a wetland or buffer area. He stated residents are not allowed to remove trees from 10 <br />a wetland zoning district areas and he will so notify this resident. He stated a Staff analysis was 11 <br />conducted to assure a wetland permit was not needed for this structure. 12 <br /> 13 <br />Councilmember Thomas noted this request does not deal with additional surface area. Director 14 <br />Ericson stated that is correct. 15 <br /> 16 <br />Tom Hansen, 7069 Pleasant View Drive, stated he is the applicant and did not cut down any trees 17 <br />from the wetland, just brush cutting to find the north side property corner. He stated there was 18 <br />one dead elm on the property line that leaned over the site where the garage would be so he did 19 <br />cut it down. The house is set two feet above the street level to stay above the street level. Runoff 20 <br />is sloped toward the street and in the back is sloped toward the back wetland area. Mr. Hansen 21 <br />noted that the property to the north is the lowest in the area. 22 <br /> 23 <br />Mr. Hansen stated he had his site graded properly and the garage is sitting above street level so 24 <br />there is some grade down to the property line and it is sloped toward the back to send drainage 25 <br />toward the wetland, not to the south side neighbor. He stated they took that into consideration 26 <br />and are willing to make some changes once Staff looks at the property. He restated they have 27 <br />attempted to direct the water toward the street or wetland in the back. 28 <br /> 29 <br />Mayor Marty asked City Staff to inspect the property. He pointed out that if the workshop had 30 <br />direct access to the house, the conditional use permit would not have been needed. 31 <br /> 32 <br />Mr. Hansen explained that would have put the door into the family room, which is not a good 33 <br />layout. For convenience and safety, he wanted the shop in the garage instead of the basement 34 <br />where there is a gas water heater and contains living space. 35 <br /> 36 <br />Mayor Marty stated he talked with Director Ericson about the 3-car garage and curb cut 37 <br />regulations. Mr. Hansen stated he is aware of that and thinking about 18 feet at the curb side so 38 <br />it will be under the maximum allowed. 39 <br /> 40 <br />Mayor Marty closed the public hearing at 7:55 p.m. 41 <br /> 42 <br />Councilmember Flaherty asked what will be done in the workshop. Mr. Hansen stated it is a 43 <br />hobby of wood working and he will not be conducting a business. 44 <br /> 45
