Mounds View City Council September 12, 2005 <br />Regular Meeting Page 6 <br /> <br />Councilmember Flaherty stated he would prefer to table pending inspection of Staff because of 1 <br />the concern expressed about the runoff and trees. 2 <br /> 3 <br />Councilmember Thomas stated she thinks it is not necessary to table since it can be included as a 4 <br />condition of approval. She noted that the runoff issues and the item on the agenda are not 5 <br />related. There is no change in the surface area and it is Staff’s responsibility to check the grading 6 <br />and runoff issues. 7 <br /> 8 <br />Mayor Marty stated he can see both sides of the issue but believes that if this item is tabled, the 9 <br />City still has some control over the situation. 10 <br /> 11 <br />Councilmember Thomas suggested those conditions be added to the resolution. 12 <br /> 13 <br />MOTION/SECOND: Stigney/Gunn. To waive the reading and adopt Resolution 6613 14 <br />Approving a Conditional Use Permit (CUP) for a 1,082 square-foot Garage at 7069 Pleasant 15 <br />View Drive; Planning Case No. CU2005-006; as amended to add Condition #2, Staff to address 16 <br />runoff problem satisfactorily. 17 <br /> 18 <br />Director Ericson explained that it is not necessary to add a stipulation regarding trees since it 19 <br />does not relate to the Conditional Use Permit for the garage. He stated that Mr. Hansen is now 20 <br />aware that trees cannot be cut from the wetland district. 21 <br /> 22 <br />Mayor Marty stated that cutting a purportedly dead tree from the neighbor’s property is a concern 23 <br />to him. Director Ericson agreed and stated Staff certainly does not encourage a resident from cut 24 <br />down another resident’s tree. 25 <br /> 26 <br />Councilmember Flaherty asked for an explanation of the amendment. 27 <br /> 28 <br />Councilmember Stigney stated it would require the concerned neighbor to be satisfied and assure 29 <br />it does not fall through the cracks, which would not happen anyway. 30 <br /> 31 <br />Councilmember Flaherty stated the water runoff is his concern and he agrees with the motion on 32 <br />the floor. 33 <br /> 34 <br />Director Ericson stated Staff will visit the site tomorrow. 35 <br /> 36 <br /> Ayes-5 Nays-0 Motion carried. 37 <br /> 38 <br />B. Transfer of Ownership is from 41 <br />Mounds View Jake’s Inc., to Thomas Stuart 42 <br /> 43 <br />Administrative Assistant Crane advised that this Public Hearing needs to be continued to the 44 <br />September 26, 2005, City Council meeting because the closing of sale on the property has been 45
