Mounds View City Council September 12, 2005 Regular Meeting Page 6 Councilmember Flaherty stated he would prefer to table pending inspection of Staff because of 1 the concern expressed about the runoff and trees. 2 3 Councilmember Thomas stated she thinks it is not necessary to table since it can be included as a 4 condition of approval. She noted that the runoff issues and the item on the agenda are not 5 related. There is no change in the surface area and it is Staff’s responsibility to check the grading 6 and runoff issues. 7 8 Mayor Marty stated he can see both sides of the issue but believes that if this item is tabled, the 9 City still has some control over the situation. 10 11 Councilmember Thomas suggested those conditions be added to the resolution. 12 13 MOTION/SECOND: Stigney/Gunn. To waive the reading and adopt Resolution 6613 14 Approving a Conditional Use Permit (CUP) for a 1,082 square-foot Garage at 7069 Pleasant 15 View Drive; Planning Case No. CU2005-006; as amended to add Condition #2, Staff to address 16 runoff problem satisfactorily. 17 18 Director Ericson explained that it is not necessary to add a stipulation regarding trees since it 19 does not relate to the Conditional Use Permit for the garage. He stated that Mr. Hansen is now 20 aware that trees cannot be cut from the wetland district. 21 22 Mayor Marty stated that cutting a purportedly dead tree from the neighbor’s property is a concern 23 to him. Director Ericson agreed and stated Staff certainly does not encourage a resident from cut 24 down another resident’s tree. 25 26 Councilmember Flaherty asked for an explanation of the amendment. 27 28 Councilmember Stigney stated it would require the concerned neighbor to be satisfied and assure 29 it does not fall through the cracks, which would not happen anyway. 30 31 Councilmember Flaherty stated the water runoff is his concern and he agrees with the motion on 32 the floor. 33 34 Director Ericson stated Staff will visit the site tomorrow. 35 36 Ayes-5 Nays-0 Motion carried. 37 38 B. Continued Public Hearing from August 22, 2005 for Resolution 6600 A 39 Transfer of Ownership of an On-Sale Intoxicating Liquor License for Jake’s 40 Sports Café located at 2400 Highway 10.
