If that 1 <br />happens, where does that leave him as a taxpayer of the City of Mounds View. He asked if the 2 <br />City has considered what the coming obligations may be in terms of Ramsey County, the 3 <br />developer, the applicant, and the list goes on. He stated quite obviously, regardless of what over 4 <br />1,100 citizens had to say who signed the petition, or he has said, or the people he has been 5 <br />working with, the Council has kept plodding on oblivious of their concerns. Mr. McCarty stated 6 <br />that is the Council’s choice and responsibility and will have to stand for that. But, as a citizen 7 <br />taxpayer, he asked if the Council has considered, or is there even a guess of how much it will 8 <br />cost the City should the City loose and the residents prevail on this question before the courts. 9 <br />He asked if there has been any guess at all or understanding or consideration of the risk being 10 <br />taken having been fully informed and appraised of a potential suit on this issue. 11 <br /> 12 <br />Councilmember Thomas stated the Council cannot speculate on legal situations they are not yet 13 <br />in. That being said, she stated she somewhat takes offense at the term “being oblivious to the 14 <br />concerns of the residents” because the Council is not and every step and decision was fully 15 <br />considered. She stated she does not have a number and will not speculate legal conditions that 16 <br />are not before the Council. She stated that with every choice that was made the Council fully 17 <br />considered the opinions of those they agreed with and those they did not agree with. 18 <br /> 19 <br />Mayor Marty stated this can be debated all night and he has thought about this and a number of 20 <br />different scenarios. He stated that even when the group brought in the petition, the Council 21 <br />cannot go on hypotheticals until faced with something. Once the Council is, then they will 22 <br />address that. 23 <br /> 24 <br />Mr. McCarty asked if the Council has considered speculating on the obvious. Mayor Marty 25 <br />stated that until the Council is faced with a suit, that is when the Council will have to take it 26 <br />seriously. 27 <br /> 28 <br />M. ITEM DELETED 29 <br /> 30 <br />N. Resolution 6646 Declaring a Local Emergency as a Result of the September 31 <br />21st Storm 32 <br /> 33 <br />Mayor Marty stated he met with City Administrator Ulrich, Police Chief Sommer who is also the 34 <br />Emergency Management Coordinator, and Councilmember Flaherty to sign an emergency 35 <br />declaration. 36 <br /> 37 <br />Police Chief Sommer explained that a local emergency may be declared only by the Mayor of a 38 <br />municipality for the purpose of activating the City emergency operation plan and authorizing aid 39 <br />and assistance. The local emergency declaration empowers the City to enter into contracts and 40 <br />incur obligations necessary to combat the emergency by protecting the health and safety of 41 <br />persons and property, and providing emergency assistance to those in need without compliance 42 <br />with time consuming procedures and formalities prescribed by law pertaining to the performance 43 <br />of public work. 44 <br /> 45
