Item No. 03B <br />Meeting Date: December 6, 2005 <br />Type of Business: Work Session <br />City Administrator Review _______ <br /> <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant to the City Administrator <br />Item Title/Subject: Discuss Revising Section 502.08 of the Mounds View <br />City Code in regard to Public Hearing of Liquor <br />License Renewals <br /> <br /> <br />Section 502.08 of the City Code requires that a public hearing be held prior to the <br />renewal of any intoxicating liquor license. Section 502.08 states: <br /> <br />502.08: LICENSE HEARING: No issuance of a new license or <br />transfer of an existing license for the sale of intoxicating liquor <br />on-sale, off-sale, club, Sunday sales or on-sale wine shall be <br />hereafter granted by the Council until a public hearing has <br />been conducted by the Council after published notice in the <br />official newspaper at least ten (10) days in advance of the <br />hearing. Renewals of existing licenses issued under this <br />Chapter and the issuance of temporary intoxicating <br />special event and banquet licenses as defined in Section <br />502.03, subdivisions 6 and 7 of this Chapter may be <br />granted by the Council after a public hearing without the <br />requirement of a prior published notice. <br /> <br /> <br />Staff feels that this section of the Code needs to be revised. The concern is the <br />requirements of all intoxicating liquor license renewals go before a public hearing <br />without the requirement of published notice. A public hearing is used to encourage <br />input from residents. By not publishing the notice, residents would not be aware of a <br />liquor license renewal, and therefore, the City may not be aware of problems other <br />than what is offered by police reports. <br /> <br />Staff recommends amending Section 502.08 to read that public notice is required on <br />all renewal liquor licenses. If the City Council is in approval, then Staff will start the <br />process of revising the code by the Ordinance process. <br /> <br />Respectfully submitted, <br />Desaree Crane
