Item No: 8D <br />Meeting Date: Jan 12, 2004 <br />Type of Business: Consent <br />Administrator Review : _______ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jim Ericson, Community Development Director <br />Item Title/Subject: Set a Public Hearing for 7:05 pm, Monday, January 26, <br />2004, for the First Reading and Introduction of <br />Ordinance 725 Amending the Zoning Code to establish <br />an Administrative Variance Approval Process. <br /> <br />Background: <br /> <br />The Planning Commission is proposing an amendment to the Zoning Code that would create <br />an administrative variance review procedure. Such a procedure would reduce the cost and <br />the amount of time needed to process minor variance requests for residents. The ordinance <br />is under consideration due to the large number of variance requests that are received and <br />processed by the city. <br /> <br />Discussion <br /> <br />The administrative variance process would allow the Community Development Director to <br />grant variances for properties zoned R-1 or R-2, where the request is pertaining to setbacks <br />and is within twenty-five (25) percent of code. The request cannot create a setback of less <br />than five (5) feet. The proposed process for approval of an administrative variance would be <br />three-fold. The Community Development Director will review the request. If the Director <br />chooses to approve, the adjacent neighbors and the Planning Commission will have a <br />chance to review the approval and have the right to overturn the decision if they disagree <br />with administrative approval. If the request was denied or overturned, the applicant would be <br />able to request a formal variance from the Planning Commission. <br /> <br />The fee for administrative variances will be set in the fee schedule. The proposed fees <br />would be seventy-five ($75) dollars for an administrative variance request and an additional <br />one hundred ($100) dollars if a formal variance becomes necessary. <br /> <br />Recommendation: <br /> <br />The request is to set the public hearing and first reading of the amendment for Monday, <br />January 26, 2004. <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Community Development Director <br />763-717-4021 <br />
