Set a Public Hearing for 7:10 p.m., Monday, April 26, 2004 to Consider 4 <br />Resolution 6225 Approving an Off Sale Intoxicating Liquor License for Sid’s 5 <br />Discount Liquors 6 <br /> 7 <br />Council Member Gunn asked whether the background investigations have been completed. 8 <br /> 9 <br />Community Development Director Ericson indicated that the background investigation is in 10 <br />process and will be completed by the time of the public hearing. 11 <br /> 12 <br />MOTION/SECOND: Gunn/Quick. To Approve Consent Agenda Item D as Presented. 13 <br /> 14 <br /> Ayes – 5 Nays – 0 Motion carried. 15 <br /> 16 <br />F. Resolution 6223 Authorizing the Preparation of a Preliminary Feasibility 17 <br />Report and Consultant Selection for the Hidden Hollow Street and Utility 18 <br />Installation Project 19 <br /> 20 <br />Council Member Marty indicated that at the time that this Staff report was given to Council the 21 <br />developer had not executed a petition for public improvement and he does not feel that Council 22 <br />should take any further action until they have. 23 <br /> 24 <br />Community Development Director Ericson indicated the petition and waiver of assessment has 25 <br />been drafted and reviewed by the City Attorney and the development team and there appear to be 26 <br />no issues with it. He further commented that the developer has every intention of moving 27 <br />forward and will be responsible for all fees associated with this. 28 <br /> 29 <br />Council Member Marty said he feels this is premature and he would prefer to have the executed 30 <br />petition before Council acts. 31 <br /> 32 <br />Council Member Stigney pointed out that the approval is contingent upon Procraft submitting the 33 <br />executed petition for public improvement. 34 <br /> 35 <br />City Attorney Riggs indicated that he feels it would be appropriate to act on the Resolution 36 <br />because there is a contingency written in to it. 37 <br /> 38 <br />MOTION/SECOND: Quick/Marty. To Approve Consent Agenda Items as Presented. 39 <br /> 40 <br />Ayes – 5 Nays – 0 Motion carried. 41 <br /> 42
