CVS Report <br />May 24, 2004 <br />Page 16 <br /> <br />RESOLUTION NO. 6270 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING <br />THE “VELMEIR CVS ADDITION” PRELIMINARY PLAT <br />AND DEVELOPMENT REVIEW <br />MOUNDS VIEW PLANNING CASE NOS. MA2004-002 AND DE2004-001 <br /> <br />WHEREAS, The Velmeir Companies (“Velmeir”) has requested approval of a <br />preliminary plat and a development review for the “Velmeir CVS Addition” major subdivision <br />on land located at the southwest corner of County Road 10 and Silver Lake Road, legally- <br />described as follows: <br /> <br />That part of Lot 59, Auditor’s Subdivision No. 89, lying South of a line described as <br />follows: Commencing at the Northwest corner of said lot 59; thence South along the <br />West line of said Lot 59, 257.93 feet to the point of beginning; thence Southeasterly to <br />a point on the East line of said Lot 59, 257.93 feet South of the Northeast corner and <br />there terminating. Together with: Lot 58, except the West 100 feet lying Northerly of the <br />Southerly 514.63 feet thereof, Auditor’s Subdivision No. 89, Together with: Subject to <br />Highway, except the South 514.63 feet of the West 100 feet of Lot 58, Auditor’s <br />Subdivision No. 89, Together with: Lots 1 and 2, Block 1, Amoco Silver Addition, <br />according to the recorded plat thereof, Ramsey County, Minnesota. <br /> <br />WHEREAS, Velmeir has submitted a Preliminary Plat for the major subdivision <br />which creates 3 lots; and, <br /> <br />WHEREAS, the community development and public works staff, the city engineer <br />and the city attorney have all reviewed the preliminary plat and find that it satisfies the <br />minimum subdivision requirements as articulated in Titles 1100 and 1200 of the Mounds <br />View Municipal Code and complies with county platting requirements; and, <br /> <br />WHEREAS, in accordance with Section 1204.04, Subd. 4, the subdivision is subject <br />to a park dedication fee which would be equivalent to 10% of the assessed value of the <br />project area, which has yet to be determined; and, <br /> <br />WHEREAS, the proposed subdivision is NOT within a Wetland Zoning District; and, <br /> <br />WHEREAS, Velmeir has submitted the grading and drainage plan to Rice Creek <br />Watershed District; and, <br /> <br />WHEREAS, proof of parking (up to 15% of the total parking requirement) can be <br />granted by the City Council when it is determined that the parking requirement is greater <br />than needed; and,
