Granting the variance requested would not confer on the applicant any special privilege that <br />is denied by this Title to owners of other lands, structures or buildings in the same district. <br /> <br />Granting the variance would confer upon the property owner a special privilege that <br />is denied to other property owners in the same district. <br /> <br />e. The variance requested is the minimum variance which would alleviate the hardship. <br />Economic conditions alone shall not be considered a hardship. <br /> <br />The applicant indicates that thirteen feet is the minimum to alleviate his hardship. <br /> <br />f. The variance would not be materially detrimental to the purpose of this Title or to other <br />property in the same zone. <br /> <br /> <br />A 48-foot wide garage would not necessarily be detrimental to the purpose and intent <br />of the Zoning Code, in the sense that it would not have a negative impact on the <br />surrounding area, however, from an aesthetic standpoint, it would not reflect the <br />principles of the Code. <br /> <br />g. The proposed variance will not impair an adequate supply of light and air to adjacent <br />property or substantially increase the congestion of the public streets or increase the danger <br />of fire or endanger the public safety or substantially diminish or impair property values within <br />the neighborhood. <br /> <br />The proposed garage addition should not have any impact on the supply of light or air <br />to adjacent properties, nor should it impact congestion of streets. The proposed <br />addition will not increase the danger of fire, endanger the public safety or decrease <br />property values in the neighborhood. <br /> <br />Summary All of the criteria, as indicated above, need to be satisfied to justify granting the <br />variance. The City Council needs to review the criteria and determine whether the variance <br />should be supported. <br /> <br />CUP Considerations: <br /> <br />Code Consistency <br /> <br />Subdivision 6 of Section 1106.04 lists the conditions under which a conditional use permit <br />can be issued. These are as follows: <br /> <br />a. The accessory building must conform with Section 1103.06 and subdivision 1106.03(l) <br />of this Title. <br /> b. The combined square footage of all accessory buildings on one (1) lot cannot exceed <br />one thousand eight hundred (1,800) square feet.
