Read Variance and CUP <br />June 28, 2004 <br />Page 4 <br /> c. The building shall be designed and maintained to provide a uniform appearance with <br />the dwelling unit. <br /> <br />d. The width of the building cannot exceed thirty-five feet (35'). <br /> <br />e. The building shall be a permanent structure. <br /> f. Should the use for which the permit was granted be changed, the permit shall be <br />subject to reconsideration, revocation or other action regulated by Code. <br /> <br />Section 1103.06 refers to the location of accessory buildings in side and rear yards. The <br />proposed garage satisfies this requirement. Section 1106.03 refers to specific standards <br />such as height, area, setbacks, coverage ratios, use requirements, total number of <br />accessory buildings allowed and exterior siding requirements, all of which are satisfied with <br />this request. All of the requirements addressed above would be satisfied with the exception <br />of the width requirement. <br /> <br />Conditional Use Criteria <br /> <br />In granting a conditional use permit, the City Council shall consider the advice and <br />recommendations of the Planning Commission (see “Adverse Effects” on the next page), and <br />the effect of the proposed use on the Comprehensive Plan and upon the health, safety and <br />general welfare of occupants of surrounding lands. Among other things, the City Council shall <br />make the following findings where applicable: <br /> <br />(1) The use will not create an excessive burden on existing parks, schools, streets and other <br />public facilities and utilities which serve or are proposed to serve the area. <br /> <br />The proposed garage would cause none of these identified problems. <br /> <br />(2) The use will be sufficiently compatible or separated by distance or screening from adjacent <br />residentially zoned or used land so that existing homes will not be depreciated in value and <br />there will be no deterrence to development of vacant land. <br /> <br />While the proposed garage would be 624 square feet larger than the existing garage, <br />adjacent properties should not be negatively impacted. <br /> <br />(3) The structure and site shall have an appearance that will not have an adverse effect upon <br />adjacent residential properties. <br /> <br />The proposed garage should not impact any adjacent properties. <br /> <br />(4) The use, in the opinion of the City Council, is reasonably related to the overall needs of the <br />City and to the existing land use. <br /> <br />The property owners own multiple vehicles, which were being parked in the back yard. The <br />request is reasonably related to their needs.
