<br />Item No: 10G <br />Meeting Date: 08/09/04 <br /> Type of Business: CB <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Kurt Ulrich, City Administrator <br />Item Title/Subject: Resolution 6307 Revising Section 3.25(D) of the Mounds View <br />Personnel Policy Regarding Compensatory Time. <br /> <br /> <br />Background: <br />Section 3.25D of the City Personnel Policy currently reads: <br /> <br /> COMPENSATORY TIME <br />Compensatory time off in lieu of cash payment is allowed only in accordance <br />with the Fair Labor Standards Act. Compensatory time is computed at a rate of <br />one and one-half times the hours worked in excess of the established work <br />week. The maximum total accrued compensatory time shall not exceed 240 <br />hours per employee. <br /> <br />Accrued compensatory time may be taken as paid leave by non-exempt <br />employees with prior approval of their respective Department Head. If an <br />employee is terminated from employment they will be compensated for <br />accumulated compensatory time earned, up to the above-stated maximum. <br /> <br />The City Council recently approved a contract with AFSCME Employees that adopted a <br />compensatory time policy that is more restrictive then the current personnel manual. At <br />the time the AFSCME contract was approved, the Council asked that the compensatory <br />time portion of the Personnel Manual be considered for an amendment reflecting the <br />provisions of the AFSCME contract. In this way, consistency is maintained between the <br />different employee groups. <br /> <br />In regard to other employee groups, the police officer’s contract allows for 50 hours of <br />compensatory time to be accumulated in lieu of overtime. Police sergeants do not <br />currently receive overtime. Public works and non-union employees are covered under <br />the Personnel Manual. <br /> <br />Discussion: <br />All City employees were notified of potential changes to the personnel ordinance in <br />regard to compensatory time. The only concern expressed was by the Public Works <br />collective bargaining group. As part of the 2004-05 contract negotiations they are <br />requesting a 160 hour maximum accrual with no limit on annual usage. They currently <br />receive 240 hours of compensatory time under the personnel manual. <br /> <br />One of the reasons given by public works employees to justify a different level of <br />overtime is the fact that they are required to work 50-60 on-call hours per year. <br />A review of past compensatory time usage by public works indicates that there are only a <br />couple of employees that take in excess of 80 hours per year in compensatory time. The <br />City would realize cash savings if more employees utilized compensatory time rather than <br />overtime. Work that would not be accomplished due to compensatory time off can be
