Mounds View City Council August 9, 2004 <br />Regular Meeting Page 8 <br /> <br />Planning Associate Prososki stated the applicant was appealing the Planning Commission’s 1 <br />denial of this request due to lack of hardship, and is asking the Council to table the item until 2 <br />September 13th because he is presently out of the country. She stated the applicant constructed 3 <br />this driveway without a permit, and is requesting to be able to leave it there because it is 4 <br />patterned, and to remove part of it would disturb the patterning. 5 <br /> 6 <br />Planning Associate Prososki stated one resident of the neighborhood had spoke during the 7 <br />Planning Commission’s meeting in favor of the driveway because it improved the neighborhood. 8 <br /> 9 <br />Mayor Linke stated the applicant had appeared ten years ago before the Council with the same 10 <br />request and was turned down. 11 <br /> 12 <br />Council Member Marty stated that due to the fact this was constructed without a permit and 13 <br />exceeds the maximum curb cut width, he concurs with the Planning Commission 100 percent. 14 <br /> 15 <br />Mayor Linke closed the public hearing at 7:53 p.m. 16 <br /> 17 <br />MOTION/SECOND. Stigney/Marty. To waive the reading and approve Resolution 6322, 18 <br />affirming the Planning Commission’s denial of the variance requested at 7090 Silver 19 <br />Lake Road. 20 <br /> 21 <br />Council Member Stigney stated he agrees with the Planning Commission’s recommendation. 22 <br /> 23 <br /> Ayes-5 Nays-0 Motion carried. 24 <br /> 25 <br />D Introduction and First Reading of Ordinance 750, Vacating Easements 26 <br />Related to Hidden Hollow Final Plat 27 <br /> 28 <br />Planning Associate Prososki stated the easements are unnecessary because the utilities and 29 <br />highway were never put in place, the utilities that were in place in some areas are being relocated 30 <br />due to the development, and that Hidden Hollow’s final plat dedicated the necessary easements 31 <br />for the utilities that will be put in place. She stated the Second Reading is scheduled for August 32 <br />23rd. 33 <br /> 34 <br />Council Member Marty asked where the remaining easements are going to be, and Planning 35 <br />Associate Prososki stated she could attach that map with the Second Reading. She stated that 36 <br />basically all the easements on the bottom of the page are going to be covered by a new easement 37 <br />that covers ponding in that area. 38 <br /> 39 <br />MOTION/SECOND: Marty/Quick. To waive the reading and adopt the First Reading of 40 <br />Ordinance 750, Vacating Easements Related to Hidden Hollow Final Plat. 41 <br /> 42 <br /> Ayes –5 Nays – 0 Motion carried 43 <br /> 44 <br />E.
