Mounds View City Council August 9, 2004 Regular Meeting Page 8 Planning Associate Prososki stated the applicant was appealing the Planning Commission’s 1 denial of this request due to lack of hardship, and is asking the Council to table the item until 2 September 13th because he is presently out of the country. She stated the applicant constructed 3 this driveway without a permit, and is requesting to be able to leave it there because it is 4 patterned, and to remove part of it would disturb the patterning. 5 6 Planning Associate Prososki stated one resident of the neighborhood had spoke during the 7 Planning Commission’s meeting in favor of the driveway because it improved the neighborhood. 8 9 Mayor Linke stated the applicant had appeared ten years ago before the Council with the same 10 request and was turned down. 11 12 Council Member Marty stated that due to the fact this was constructed without a permit and 13 exceeds the maximum curb cut width, he concurs with the Planning Commission 100 percent. 14 15 Mayor Linke closed the public hearing at 7:53 p.m. 16 17 MOTION/SECOND. Stigney/Marty. To waive the reading and approve Resolution 6322, 18 affirming the Planning Commission’s denial of the variance requested at 7090 Silver 19 Lake Road. 20 21 Council Member Stigney stated he agrees with the Planning Commission’s recommendation. 22 23 Ayes-5 Nays-0 Motion carried. 24 25 D Introduction and First Reading of Ordinance 750, Vacating Easements 26 Related to Hidden Hollow Final Plat 27 28 Planning Associate Prososki stated the easements are unnecessary because the utilities and 29 highway were never put in place, the utilities that were in place in some areas are being relocated 30 due to the development, and that Hidden Hollow’s final plat dedicated the necessary easements 31 for the utilities that will be put in place. She stated the Second Reading is scheduled for August 32 23rd. 33 34 Council Member Marty asked where the remaining easements are going to be, and Planning 35 Associate Prososki stated she could attach that map with the Second Reading. She stated that 36 basically all the easements on the bottom of the page are going to be covered by a new easement 37 that covers ponding in that area. 38 39 MOTION/SECOND: Marty/Quick. To waive the reading and adopt the First Reading of 40 Ordinance 750, Vacating Easements Related to Hidden Hollow Final Plat. 41 42 Ayes –5 Nays – 0 Motion carried 43 44 E.
