Mounds View City Council September 13, 2004 <br />Regular Meeting Page 6 <br /> <br />Mayor Linke opened the public hearing. 1 <br /> 2 <br />Director Ericson stated that this is the second reading of Ordinance 752. He stated that the City 3 <br />Council had directed Staff and the Planning Commission to review the Zoning Code relating to 4 <br />driveway setbacks, and that currently there is a one-foot allowance. He stated that there have 5 <br />been some issues with that. He stated the Planning Commission has looked at the Code and is 6 <br />recommending some language that would bring the setback of driveways back to five feet in 7 <br />residential districts, and if a variance is needed or a shorter setback, the applicant would need to 8 <br />go through the variance procedure through the Planning Commission. 9 <br /> 10 <br />Council Member Marty stated there had been a potential of a neighbor being coerced, so he 11 <br />thought that this would clean it up. 12 <br /> 13 <br />Mayor Lin ke closed the public hearing. 14 <br /> 15 <br />MOTION/SECOND. Marty/Stigney. To waive the reading and adopt Ordinance 752, an 16 <br />Ordinance Amending the Zoning Code Relating to Driveway Setbacks. 17 <br /> 18 <br />ROLL CALL. Linke/Marty/Stigney/Gunn. 19 <br /> 20 <br /> Ayes-4 Nays-0 Motion carried. 21 <br /> 22 <br /> G. Second Reading and Adoption of Ordinance 746, an Ordinance Implementing a Franchise 23 <br />Fee on Xcel Energy Electric and Natural Gas Operations within the City of Mounds View 24 <br />for the Year 2005. (Roll Call Vote) 25 <br /> 26 <br />Mayor Linke stated that this is the 4 percent franchise. 27 <br /> 28 <br />MOTION/SECOND. Marty/Gunn. To waive the reading and adopt Ordinance 746, an Ordinance 29 <br />Implementing a Franchise Fee on Xcel Energy Electric and Natural Gas Operations within the City of 30 <br />Mounds View for the Year 2005. 31 <br /> 32 <br />Council Member Stigney stated that this continues to be the 4 percent that has been effect last year and 33 <br />previous years on electric and gas in the city. 34 <br /> 35 <br />Council Member Marty stated that there is a sunset clause that will automatically sunset on December 36 <br />31, 2005. 37 <br /> 38 <br />ROLL CALL.
