The offer was submitted by the <br />Mounds View Animal Hospital, who intends to construct a new freestanding facility on the <br />site. They have received City approvals for the development; the last step is the public <br />hearing for the sale of land which is required by Minnesota Statutes. The accepted offer <br />for the property was $50,000. <br /> <br />Staff had originally set a public hearing date for September 24, 2001, but due to a <br />publication problem, the notice was not published and as a result the public hearing was <br />renoticed for October 1, 2001. <br /> <br />Discussion: <br /> <br />Chapter 469 of Minnesota Statutes requires that the EDA hold a public hearing prior to <br />the sale of any land it owns. This public hearing satisfies the Minnesota statutory <br />requirements. <br /> <br />The purchase Agreement that the City entered with the Mounds View Animal Hospital <br />was contingent upon obtaining City development approvals for the site. With the <br />approval of the Rezoning, Code revision, Conditional Use Permit and the Development <br />Review, this contingency has been satisfied. The last requirement is the public hearing <br />to consider the sale to the proposed purchaser, Mounds View Animal Hospital. <br /> <br />Consistency with Comprehensive Plan: City staff and the Mounds View Planning <br />Commission feel that the proposed sale would be consistent with the City’s <br />Comprehensive Plan and the proposed development would be consistent with and <br />appropriate for the existing neighborhood. The property has a future land use <br />designation of Community Commercial, and the proposed use is consistent with that <br />designation. The definition of Community Commercial, as indicated in the <br />Comprehensive Plan, is as follows: <br />“Land use principally engaged in the provision of goods or services with a primary
