Mounds View City Council February 24, 2003 <br />Regular Meeting Page 12 <br /> <br /> 1 <br />Mayor Linke asked Mr. Ericson to have Julie Fleming Wolfe provide the information to City 2 <br />Hall to be picked up. 3 <br /> 4 <br />Council Member Stigney indicated he had not heard anything on his three data practices requests 5 <br />and asked for a status update. 6 <br /> 7 <br />Interim City Administrator Ericson indicated that he had no requests for data from Council 8 <br />Member Stigney and asked him to resubmit the requests to be processed immediately. 9 <br /> 10 <br />Mayor Linke indicated he does not approve of the policy of having Council Members submit 11 <br />requests in writing as they are elected to run the City and should have access to all information 12 <br />provided it is not private. 13 <br /> 14 <br />City Attorney Riggs indicated that there is no exception to the data practices requirements for 15 <br />Council Members. 16 <br /> 17 <br />Mayor Linke said he feels it is ludicrous to have to beg for the information he needs to do his job. 18 <br />He then asked whether the request needs to be written or could be verbal. 19 <br /> 20 <br />City Attorney Riggs indicated the City has a policy that requires the request to be in writing and 21 <br />the statute requires that a responsible authority be designated in the City and that is the clerk 22 <br />administrator and the clerk administrator has an obligation to follow the statute. 23 <br /> 24 <br />Interim City Administrator Ericson asked that Council provide their written requests to him and 25 <br />he would research the requests as quickly as possible. 26 <br /> 27 <br />Mayor Linke indicated that the use of sick leave per LELS was discussed at the last meeting and 28 <br />tabled and he would like to take it off the table for discussion. 29 <br /> 30 <br />MOTION/SECOND: Linke/Marty. To Take the Use of Sick Leave per LELS off the Table for 31 <br />Discussion and Consideration. 32 <br /> 33 <br /> Ayes – 3 Nays – 1(Stigney) Motion carried. 34 <br /> 35 <br />Council Member Marty indicated that this would be revisited again but the individual that needs 36 <br />it needs it right now and he feels Council should discuss this but he does not have all the 37 <br />information and wonders whether it should be referred to a work session. 38 <br /> 39 <br />Mayor Linke read Resolution 5943. 40 <br /> 41 <br />Mayor Linke indicated he had received the information he needed to determine how to vote and 42 <br />that was how it would affect the LELS but it does not affect it as the City can do whatever it 43 <br />wants to in the personnel policy.
