Mounds View City Council February 24, 2003 Regular Meeting Page 12 1 Mayor Linke asked Mr. Ericson to have Julie Fleming Wolfe provide the information to City 2 Hall to be picked up. 3 4 Council Member Stigney indicated he had not heard anything on his three data practices requests 5 and asked for a status update. 6 7 Interim City Administrator Ericson indicated that he had no requests for data from Council 8 Member Stigney and asked him to resubmit the requests to be processed immediately. 9 10 Mayor Linke indicated he does not approve of the policy of having Council Members submit 11 requests in writing as they are elected to run the City and should have access to all information 12 provided it is not private. 13 14 City Attorney Riggs indicated that there is no exception to the data practices requirements for 15 Council Members. 16 17 Mayor Linke said he feels it is ludicrous to have to beg for the information he needs to do his job. 18 He then asked whether the request needs to be written or could be verbal. 19 20 City Attorney Riggs indicated the City has a policy that requires the request to be in writing and 21 the statute requires that a responsible authority be designated in the City and that is the clerk 22 administrator and the clerk administrator has an obligation to follow the statute. 23 24 Interim City Administrator Ericson asked that Council provide their written requests to him and 25 he would research the requests as quickly as possible. 26 27 Mayor Linke indicated that the use of sick leave per LELS was discussed at the last meeting and 28 tabled and he would like to take it off the table for discussion. 29 30 MOTION/SECOND: Linke/Marty. To Take the Use of Sick Leave per LELS off the Table for 31 Discussion and Consideration. 32 33 Ayes – 3 Nays – 1(Stigney) Motion carried. 34 35 Council Member Marty indicated that this would be revisited again but the individual that needs 36 it needs it right now and he feels Council should discuss this but he does not have all the 37 information and wonders whether it should be referred to a work session. 38 39 Mayor Linke read Resolution 5943. 40 41 Mayor Linke indicated he had received the information he needed to determine how to vote and 42 that was how it would affect the LELS but it does not affect it as the City can do whatever it 43 wants to in the personnel policy. He then said Council was willing to do it last week and with 44
