Mounds View City Council April 28, 2003 <br />Regular Meeting Page 9 <br /> <br />MOTION/SECOND: Marty/Quick. To Waive the Reading, Introduce the First Reading and 1 <br />Approve Ordinance 714, an Ordinance Amending Chapter 405 of the Mounds View Municipal 2 <br />Code Pertaining to the Parks and Recreation Commission. 3 <br /> 4 <br /> Ayes – 5 Nays – 0 Motion carried. 5 <br /> 6 <br />G. Consideration of Resolution 6005, a Resolution Approving a Settlement 7 <br />Agreement with the Attorney General’s Office Regarding the Office of the 8 <br />State Auditor (OSA) Notice of Noncompliance. 9 <br /> 10 <br />Interim City Administrator Ericson indicated that negotiations on the matter have led to a letter 11 <br />from the Attorney General’s Office concerning an agreement on the settlement of this matter. He 12 <br />then said that the Resolution attached states that the City at no time intended to willfully 13 <br />disregard the TIF statutes and there is no recognition of blame or wrongdoing on behalf of the 14 <br />City. He further commented that the penalty for failure to identify parcels is that in the future, 15 <br />the City will identify them and will not be allowed to form any new TIF districts for three 16 <br />months. 17 <br /> 18 <br />Council Member Marty commented that this leaves the City with egg on its face for not finding 19 <br />the letters. 20 <br /> 21 <br />Interim City Administrator Ericson indicated he does not take that position because the school 22 <br />and the County were notified and the fact that the record keeping of the City meant that the 23 <br />letters could not be produced does not constitute proof of wrongdoing. He further commented 24 <br />that minutes from meetings during that time indicate that the letters were sent. 25 <br /> 26 <br />Mayor Linke read Resolution 6005. 27 <br /> 28 <br />Council Member Quick commented that it is ludicrous what they are saying because he was at 29 <br />the meeting were the County and the School District were invited as interested parties concerning 30 <br />the TIF districts and it is unfortunate that those letters could not be produced to completely 31 <br />vindicate the City. 32 <br /> 33 <br />MOTION/SECOND: Stigney/Marty. To Waive the Reading of the Settlement Agreement and 34 <br />Approve Resolution 6005, a Resolution Approving a Settlement Agreement with the Attorney 35 <br />General’s Office Regarding the Office of the State Auditor (OSA) Notice of Noncompliance. 36 <br /> 37 <br /> Ayes – 5 Nays – 0 Motion carried. 38 <br /> 39 <br />H. Consideration of Resolution 6002, a Resolution Approving a Zero-Lot Line 40 <br />Minor Subdivision Request for 7656 Silver Lake Road. 41 <br /> 42 <br />Interim City Administrator Ericson indicated this is a request to further subdivide a lot 43 <br />subdivided last year to allow for a twin home located on one side of the two lots to be sold 44 <br />individually.
