Mounds View City Council September 22, 2003 <br />Regular Meeting Page 16 <br /> <br />5. Update on Community Center 1 <br /> 2 <br />City Administrator Ulrich indicated that Staff has been in negotiations with the existing caterer 3 <br />over the budget but has not yet received the insurance notice, performance bond or the required 4 <br />marketing plan. He then indicated that the City Attorney has recommended that the City allow 5 <br />the full 30 day cure period to expire and send out a letter notifying the contractor that they are not 6 <br />in compliance with the terms of the contract. 7 <br /> 8 <br />City Administrator Ulrich indicated there was a proposal from a competing vendor so there is 9 <br />potential that the City could reach a negotiated agreement on the contract prior to the 30 days or 10 <br />with a new vendor. 11 <br /> 12 <br />Mayor Linke indicated he felt it would be premature to enter into negotiations in case the 13 <br />contractor performs. 14 <br /> 15 <br />City Administrator Ulrich indicated the City Attorney has said that there could be negotiations 16 <br />with both the existing and new vendors but the City needs to allow the proper cure time. 17 <br /> 18 <br />City Attorney Riggs indicated the City would not be acting on any proposal but negotiating with 19 <br />the present contractor to let them know if they are not going to comply the City is going to find 20 <br />another vendor. 21 <br /> 22 <br />City Administrator Ulrich asked for authority to try and negotiate with the existing contractor to 23 <br />bring back options for consideration short of termination. 24 <br /> 25 <br />There was consensus of Council to proceed with negotiations. 26 <br /> 27 <br />City Administrator Ulrich indicated he had provided an Administrator’s Digest and highlighted 28 <br />that there would be thinning of trees at Groveland Park and noted that approximately 30 black 29 <br />locust trees would be removed from the area next to the playground because they are rotted and 30 <br />pose a safety hazard. The trees removed will be replaced with other plantings. 31 <br /> 32 <br />Community Development Director Ericson indicated he had attended the Ramsey County Board 33 <br />of Commissioners meeting and Ramsey County conveyed to the City tax forfeited parcels that 34 <br />were a part of the golf course that the City did not hold title to. 35 <br /> 36 <br />Director Ericson indicated that on the same day the HRA met and voted to adopt the maximum 37 <br />levy for the HRA but that does not mean they will go forward or levy the maximum but they did 38 <br />put in the process the ability to go forward. 39 <br /> 40 <br />Council Member Marty commented that he feels it is a good idea that access and authorization 41 <br />has to be approved by the City Administrator and the Cable Coordinator. He then said he would 42 <br />like Staff to determine what the proper battery charging procedure is for the type of batteries in 43 <br />the camcorder in order not to compromise battery life. 44 <br /> 45
