<br />Item No: 8E <br />Meeting Date: Nov 10, 2003 <br />Type of Business: Consent <br />Administrator Review : _______ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Authorization to Execute Sewer Connection and <br />Maintenance Agreement with Met Council <br />Environmental Services <br /> <br /> <br />Background: <br /> <br />Metropolitan Council division of Environmental Services has requested that the City enter <br />into an agreement with them to allow for the connection into their sanitary sewer main that <br />runs through the property to be developed by LandCor at the corner of Long Lake Road and <br />County Road 10. The City does not have sanitary services in this area and the plan had <br />been to instead access the Met Council line directly. <br /> <br /> <br />Discussion: <br /> <br />To access the Met Council’s primary sanitary line, they are requiring that the City execute a <br />Sewer Access and Maintenance Agreement with them. A copy of the agreement is attached. <br />The private sanitary service that would tie in to the Met Council’s line would be from the <br />office building. Met Council does not however enter into agreements with developers and <br />private entities, only the municipality in which the connection occurs. The sewer agreement <br />in its entirety would be attached to LandCor’s Development Agreement and language would <br />be added to the development agreement that subrogates the City’s responsibilities as <br />indicated in the sewer agreement on to the developer. The City will bear no cost nor assume <br />any liability regarding the agreement. <br /> <br /> <br />Recommendation: <br /> <br />Approve Resolution 6133 authorizing the execution of a sewer connection and <br />maintenance agreement with Met Council. <br /> <br /> <br /> <br /> <br />_______________________ <br />Jim Ericson <br />Community Development Director <br />763-717-4021 <br />
