Item No: 8 <br />Meeting Date: March 3, 2003 <br />Type of Business: Worksession <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Acting City Administrator <br />Item Title/Subject: Discussion Regarding Chuck Chism’s Request to <br />Reconsider Final Compensation <br /> <br />Introduction: <br /> <br />Mr. Chism was employed by the Bridges Golf Course to work in the Clubhouse and to <br />provide golf lessons from 1998 through the June of 2001. Up through the year 2000, <br />instructors were paid 70% of the lesson fees collected with the City retaining the <br />remaining 30%. In 2001, the compensation structure for providing lessons was called <br />into question and ultimately found to be lacking Council authorization. Mr. Chism <br />continued to provide lessons while the City reviewed the position. Eventually the <br />administration, with assistance from Labor Relations, created a job description that <br />eventually included provision of golf lessons. <br /> <br />The position was named “Clubhouse Clerk/Apprentice Golf Instructor.” <br /> <br />Discussion: <br /> <br />The City Council adopted Resolution 5862 On October 10, 2002 which approved the new <br />job description and established wages applicable to 2001. The Resolution also indicated <br />that Mr. Chism would be compensated at Step 2 of the wage scale effective June 16, <br />2001. (A copy of the resolution is attached for the Council’s reference.) Mr. Chism was <br />issued a check on October 23, 2002 which retroactively compensated Mr. Chism for <br />hours worked from June 16th onward. Mr. Chism however contends that he was not paid <br />for the lessons he provided from mid June through July of 2001 and has submitted <br />documentation verifying the lessons provided. While the job description had been <br />amended to include lessons, Mr. Chism further contends that he was not “on the clock” <br />when he gave lessons and thus was neither paid an hourly rate or the 70% share of the <br />lesson fees. <br /> <br />Mr. Chism is requesting to be compensated for $1,584.75. The cost to arbitrate this <br />matter, even if the City were to prevail, would exceed what Mr. Chism is requesting. <br /> <br />Recommendation: <br /> <br />Provide staff direction regarding Mr. Chism’s request. <br /> <br /> <br />_____________________________________ <br />James Ericson <br />Interim City Clerk/Administrator
