JOINT POWERS AGREEMENT <br />BETWEEN CITY OF MOUNDS VIEW <br />AND <br />RAMSEY COUNTY <br />FOR IMPROVEMENT OF <br />RICE CREEK NORTH REGIONAL TRAIL CORRIDOR <br /> <br /> <br />PARTIES <br />This Agreement, dated the ________ day of ____________, 2002, is entered <br />into, pursuant to the provisions of the Minnesota Joint Powers Act <br />(MSA 471.59), by and between the City of Mounds View, a <br />municipal corporation and political subdivision of the State of <br />Minnesota (herein “City”), and Ramsey County (herein “County). <br /> <br />RECITALS <br />The City desires to advance funding to construct a segment of a <br />biking/walking trail on County property known as the Rice Creek North <br />Regional Trail. The County is desirous in cooperating with the City to <br />advance the construction of this trail, which is proposed as part of the <br />Regional Recreation Open Space System and further delineated in the <br />Rice Creek North Regional Trail Corridor Master Plan. <br /> <br />PURPOSE <br />The purpose of this Agreement is to define the scope of each party’s <br />authority and responsibility in relationship to the construction, <br />maintenance, use and payment of costs for the project. <br /> <br />TERMS <br />NOW, THEREFORE, pursuant to the statutory authority granted to each <br />party and in consideration of the mutual undertakings herein expressed, <br />the parties agree as follows: <br /> <br />A. Access <br /> The County grants to the City, access to the County’s property <br />located on the north half of Section 17, Township 30, Range 23, <br />Ramsey County, as generally illustrated on Exhibit A, for the <br />purpose of constructing a 10-foot wide bituminous pathway, and <br />any necessary drainage structures, signage and landscaping. <br /> <br />B. Plans and Specifications <br />The City shall be responsible for preparing plans and specifications <br />and for administering the project. Plans and specifications shall be <br />subject to approval by the Ramsey County Parks and Recreation <br />Director and the Ramsey County Public Works Director prior to the <br />start of construction. <br /> <br /> <br />
