C. Construction of Project <br />The City shall construct the project pursuant to the approved final <br />plans. The City’s Director of Public Works, or a designated <br />representative shall inspect the project during the period of <br />construction to determine compliance with the approval final plans. <br />Upon completion of the project, the City shall provide the County <br />with construction record drawings containing and properly <br />illustrating the project improvements. <br /> <br /> D. Ownership of Trail Improvements <br /> Upon completion of the project to the satisfaction of the County, as <br />determined by the County Parks and Recreation Director, the <br />improvements shall become the property of the County. <br /> <br />E. Snow Removal on Trail <br />The City shall be responsible for snow removal on the segment of <br />trail constructed pursuant to this Agreement. <br /> <br />F. Operation and Maintenance of Trail Improvements <br />Upon acceptance of the improvements, the County will operate and <br />maintain the trail improvements (excluding snow removal) <br />according to County standards. <br /> <br />G. Project Cost <br />1. The City shall be responsible for all preliminary and construction <br />engineering and project administration costs. These costs are <br />not eligible for reimbursement by the County. <br />2. The estimated cost of the trail construction is $55,000. Upon <br />completion of the project, the City shall notify the County of the <br />final construction cost. <br />3. The County shall request regional park funds from the <br />Metropolitan Council in an amount sufficient to reimburse the <br />City for the actual construction cost. The County will request <br />that the Metropolitan Council incorporate the construction cost <br />in the Regional Recreation Open Space Regional Park Capital <br />Improvement Program. The County shall pay the City upon <br />receipt of the requested grant funds from the Metropolitan <br />Council. <br /> <br />GENERAL CONDITIONS <br /> <br />A. Indemnification <br /> The City shall defend, indemnify, and hold the County harmless <br />from any claims, suits or causes of action caused or arising out of <br />activities, actions or inactions of the City, its agents, contractors, <br />including their subcontractors or employees in the construction of <br />the trail. The City certifies it is adequately insured, either <br />commercially or through a self-funded program, for risks assumed <br />under this contract. Nothing in this agreement shall be construed <br />as a waiver of the County’s statutory immunities or limits of liability.
