Mounds View City Council December 9, 2002 <br />Regular Meeting Page 26 <br /> <br /> <br />Director Ericson indicated he understands the concerns and if there are any changes to what <br />Council has adopted it would be brought before Council. He then indicated that with regard to <br />design issues Clear Channel has not proven that they do not intend to comply. <br /> <br />Council Member Thomas asked why the lease termination is going from 15 to 20 years. <br /> <br />Director Ericson indicated that Clear Channel Outdoor put together a spread sheet of information <br />indicating that, due to the excessive legal fees with this case, they need 20 years to recover costs. <br />He then said that the City would remain compensated during the extra years with a continuing <br />increase each year. <br /> <br />Council Member Marty asked if Staff could indicate to Clear Channel that the Council is <br />amenable to this but would like to see that once it is approved Council would like to see the costs <br />rather than giving a blank check for five years. <br /> <br />Director Ericson said he understood the point but that information was presented to Council and <br />he is not sure what purpose it would serve after the fact as the City needs to agree to something to <br />satisfy their concerns and their issues with the lease not being able to satisfy the return and the <br />amount of expenditures already expended at this time. <br /> <br />Mayor Sonterre commented that the potential litigation costs could exceed the five years agreed <br />upon. <br /> <br />MOTION/SECOND: Thomas/Stigney. To Waive the Reading and Introduce the First Reading <br />of Ordinance 708, an Ordinance Amending Section 1008 of the Mounds View Code Relating to <br />Billboards. <br /> <br /> Ayes – 5 Nays – 0 Motion carried. <br /> <br />8. SPECIAL ORDER OF BUSINESS <br /> <br />A. Resolution 5896, a Resolution Approving a Step Increase for Aaron Backman <br /> <br />MOTION/SECOND: Marty/Stigney. To Approve Resolution 5896, a Resolution Approving a <br />Step Increase for Aaron Backman. <br /> <br />Assistant City Administrator Reed read Resolution 5896. <br /> <br /> <br /> Ayes – 5 Nays – 0 Motion carried. <br /> <br />B. Resolution 5897, a Resolution Approving a Step Increase for Jeremiah Anderson <br /> <br />Assistant City Administrator Reed read Resolution 5897.
