March 15, 2002 <br /> <br />SILVER LAKE WOODS CONDOMINIUM ASSOCIATION SUMMARY <br /> <br />The following is a review summary preformed by Greg Lee, Public Works Director for the City of <br />Mounds View. There is an issues pertaining to the Silver Lake Woods Condominium Association <br />regarding repair and maintenance responsibility of roadways and utilities within that development. <br />This was done utilizing the City of Mounds View files. Additional review will be made of minutes <br />and recordings of Council meetings referenced herein. The City’s attorney will also be consulted. <br /> <br />The purpose of this review was to get the Public Work Director familiar with this issue so he can <br />provide direction and assistance so it can come to resolution. <br /> <br />November 12, 1981 Letter from the City Administrator to Dan Boxrud of SEH. Authorization <br />was given to have the contractor to proceed with this project. <br /> <br />December 3, 1982 Letter from the Public Works Director to the Fire Chief, discussing <br />addresses and street names. States that Lake Court Drive area is private <br />and therefore not subject to the City’s street name system. <br /> <br />March 30, 1990 Declaration of Easement is recorded (Document No. 0922339). <br />Article I – Definitions <br />Article II - Grants easement over Outlot A (40 foot wide property on <br />which Lake Court Drive and Lake Court Circle are constructed on) to the <br />“units” and “lots” <br />Article III- Grants easement over Outlot A to the City <br />Article IV – Transfers maintenance responsibilities from the “Declarant” <br />(Marvin H. Anderson Construction Co.) to the Association, discusses <br />allocation of expenses <br />Article V – Insurance <br />Article VI – Construction <br />Article VII – may dedicate with in five years an easement in or fee title to <br />Outlot A to the City. <br /> <br />No Date, 1992 Non-executed Agreement between the City and the Homeowners <br />Association. City agrees to snowplow, limited patching of potholes, seal <br />coating. Homeowners agree to be responsible for all long-term <br />maintenance including: repaving, resurfacing, overlays, and major <br />improvements. The City has “no legal responsibility “ to provide any <br />services enumerated herein. Said services are being provided <br />gratuitously. This agreement can be canceled by either party. City is not <br />bound to maintain Outlot A. The City denies any legal responsibility to <br />Outlot A. <br /> <br />May 14, 1992 Letter from Mark a. Karney (attorney) to Ric Mintor stating he has not <br />heard back form the Silver Lake Woods Association as to how to <br />proceed. <br /> <br />September 9, 1992 Hand written notes: Cliff Ash of the Silver Lake Woods Association would <br />like the City to take over the streets. Discussed City’s concern with <br />liabilities and problems with the streets, as they exist. Homeowners <br />Association concerns: City ownership of streets, how to finance “heavy” <br />maintenance in the future, how City ordinance covers Lake Court Drive <br />and Lake Court Circle. <br />
