Item No. 8 <br />Type of Business: WK <br />WK: Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Greg Lee, Director of Public Works <br />Item Title/Subject: Private Street Policy - Silver Lake Woods <br />Condominium Street and Utility Maintenance <br />Issue <br /> <br />Meeting Date: September 3, 2002 <br /> <br />Background / History <br />On August 16, 2001, the City received a proposed resolution from members of <br />the Silver Lake Woods Condominium Association that would require the City to <br />be responsible for the maintenance, repair, and replacement of the private <br />streets and the utilities under them, platted as Lake Court Drive and Lake Court <br />Circle. <br /> <br />This request was presented to City Council on May 6, 2002 at a Work Session <br />meeting. Since this is not a unique situation, staff recommended that the City <br />develop a policy regarding private streets. The policy, as currently drafted, would <br />allow for the streets and utilities of the Silver Lake Woods development to be <br />transferred to the City for maintenance and ownership. Attached, as Exhibit A, is <br />a copy of the May 6th staff report including the draft Private Street Policy. <br /> <br />Also on May 6th, Council directed staff to determine what commitment the City <br />made when this issue was last discussed. The last time the Council discussed <br />this issue was at the December 4, 2000, Work Session. The direction given at <br />that time was to revise the 1993 agreement to include the utilities. <br /> <br />Staff has researched other private streets within the City and compiled a data <br />sheet, which is attached for Council’s review. The sheet shows the cost <br />associated with maintaining these streets. Based on the draft Private Street <br />Policy, the only streets that would qualify to become public are the Silver Lake <br />Woods streets. As a result of a previous contract, the City is currently responsible <br />for maintaining the Silver Lake Woods streets by plowing and performing minor <br />maintenance. <br /> <br />In the event the City Council adopts a Private Street Policy that allows the Silver <br />Lake Woods Condominium Association to dedicate its streets and utilities, there <br />remain several issues in transferring maintenance and ownership that will need <br />to be addressed.
