Mounds View City Council Page Twelve <br /> 0 Regular Meeting June 27, 1994 <br /> contacted Mayor Linke regarding the living conditions of the <br /> complex. Orduno noted that the owner had failed to pay gas and <br /> electric bills resulting in termination of service by NSP. It was <br /> further noted that a fire had occurred in the building in April and <br /> debris remained in the basement and that garbage collection service <br /> had been stopped for quite some time. <br /> Orduno explained that there are three families living in the <br /> building, all with very small children. There is no electricity in <br /> the main areas, hallways and stairwells of the building and no hot <br /> water to any part of the building. Orduno stated that upon a <br /> request from the Mayor to take any and all action to determine what <br /> steps the City could take to alleviate the existing unsafe and <br /> unhealthy living conditions, staff began the abatement process. <br /> Orduno reported that the Fire Marshall and the City's Building <br /> Inspector inspected the building on June 22 and determined that the <br /> condition of the building rendered it a hazardous building per <br /> Minnesota Statutes . Orduno stated that the Resolution No. 4590 <br /> Ordering the Abatement of a Hazardous Building Located at 7618 <br /> Edgewood Drive In the City of Mounds View and the Abatement Order <br /> will begin the process by which the City can take legal action to <br /> ensure that corrective actions will be taken to render the building <br /> safe for occupants. Orduno further explained that the Order impacts <br /> the residents of the building to the extent that the corrective <br /> actions required in the Abatement do not necessitate non-voluntary <br /> vacation of the building. Orduno stated that the City will not <br /> tolerate this type of living conditions and that the Order provides <br /> that 20 days from the date of service the conditions must be <br /> corrected or the City will contract to having conditions repaired <br /> and will charge the property owner and the lien holder. <br /> Councilmember Wuori asked how the property owner and lien holder <br /> would_ be served. <br /> Orduno explained that a process server would serve the property <br /> owner and a registered letter would be sent to the lien holder out <br /> of town and a process server in Rhode Island would then serve the <br /> lien holder. <br /> MOTION/SECOND: Linke/Blanchard to Waive the Reading and Adopt <br /> Resolution No. 4590 and Approve the Order for Abatement of a <br /> Hazardous Building Located at 7618 Edgewood Drive <br /> VOTE: 4 ayes 0 nays Motion Carried <br /> i <br />
