Mounds View City Council Page Five <br /> . Regular Meeting June 27, 1994 <br /> would allow the downsizing and relocation of an existing 528 square foot <br /> accessory building to be in compliance with City Codes. Harrington <br /> stated that Mr. Hegland is using this 528 square foot structure as a <br /> garage. Harrington further stated that this request, as proposed, meets <br /> all other applicable requirements set forth in the Municipal Code <br /> including, but not limited to, height, area and setbacks. <br /> Mayor Linke closed the public hearing at 7 : 24 p.m. <br /> MOTION/SECOND: Wuori/Quick to Adopt Resolution No. 4586 Request for <br /> Conditional Use Permit (oversized accessory building) , 7604 Spring Lake <br /> Road <br /> VOTE: 4 ayes 0 nays Motion Carried <br /> 7 : 20 p.m. - Consideration of Request for Development Review/Rezoning <br /> Townhome Development) , 2856 Highway 10 <br /> Mayor Linke opened the public hearing at 7 : 26 p.m. <br /> Paul Harrington, Community Development Coordinator, explained that Prime <br /> Builders had made application for a Development Review/Residential <br /> Planned Unit Development for a proposed 22 unit townhome project at 2856 <br /> 41, Highway 10 . Harrington listed the issues which were discussed by staff <br /> and the applicant prior to the submittal of the request. These issues <br /> were the lot area, setbacks, and frontage. Harrington stated that the <br /> primary reason for the applicant taking the PUD route was that the <br /> property involved in the project is very long and narrow which makes <br /> setback requirements somewhat difficult to meeting. <br /> Harrington stated that another issue regarding the property was an <br /> emergency egress. Harrington explained that he had spoke to both Police <br /> and Fire Chief and that they both agreed that the property needed a <br /> second point of access from the rear of the site. Harrington reported <br /> that based on this fact, the applicant approached the Knollwood Green <br /> Townhome Asso_ciat_ion___and___obtained __verbal_ permission_ to connect an <br /> emergency drive to their existing second driveway. Harrington <br /> recommended that Council , when considering action on this request, <br /> require that a written agreement be entered into between the applicant <br /> and Knollwood Green. <br /> Harrington also reported that the applicant was informed that a ponding <br /> area would need to be provided on-site to service the storm water runoff <br /> generated on the site. Harrington noted that the applicant has shown a <br /> designated area for ponding on the site plan and that a copy of this plan <br /> had been forwarded to the City's consulting engineer for review and <br /> comment. Harrington recommended that any action on the request should <br /> include a contingency requiring approved storm water ponding area. <br /> 41, Harrington explained that both of the above listed contingencies are <br /> provided in Resolution No. 4587 brought forth for Council consideration. <br />
