Mounds View City Council Page Six <br /> • Regular Meeting June 27,, 1994 <br /> Mayor Linke stated that the City should require a signed cross easement <br /> document be entered into between the two property owners and recorded by <br /> the County. <br /> Harrington introduced John DeVries, Prime Builders, Inc. Mr. DeVries <br /> reviewed the proposed development. Mr. DeVries explained to the Council <br /> that he had been granted verbal permission to share a common exit to the <br /> south of the property by the owners of Knollwood Green Condominiums. Mr. <br /> DeVrie also noted that Prime Builders would be entering into a premerger <br /> agreement with Knollwood Greens Condominiums to become one large <br /> association and for this reason there would be no reason to enter into <br /> a cross easement agreement. <br /> Mayor Linke stated that this would be one association with two separate <br /> property owners and that the agreement could become null and void if one <br /> owner changes their mind. Mayor Linke stated that, in his opinion, there <br /> should be a cross easement document entered into by both parties. <br /> Councilmember Wuori clarified that this scenario would be similar to that <br /> of Taco Bell and Kentucky Fried Chicken whereby two businesses share one <br /> access. <br /> Mayor Linke closed the public hearing at 7 : 48 p.m. <br /> • MOTION/SECOND: Wuori/Blanchard to Adopt Resolution No. 4587 Development <br /> Review/Rezoning (Townhome Development) , 2856 Highway 10 with the <br /> Contingency that a Cross Easement Document Be Entered Into Between Prime <br /> Builders and Knollwood Green Condominiums and the Easement Document Be <br /> Recorded with the County Following the City Attorney's Approval <br /> VOTE: 4 ayes 0 nays Motion Carried <br /> Paul Harrington, Community Development Coordinator, Introduced Ordinance <br /> No. 543 which would rezone the property upon which the development will <br /> take place from R-4 ,_ _High aensit_y__Residential _to _PUD,___Planned__Unit <br /> Development <br /> MOTION/SECOND: Quick/Wuori to Approve Formal Introduction of Ordinance <br /> No. 543 and Waive the Reading <br /> VOTE: 4 ayes 0 nays Motion Carried <br /> 7 : 25 p.m. - Consideration of Request for Conditional Use Permit (Minor <br /> Auto Repair) , 2975 Highway 10 <br /> Mayor Linke opened the public hearing at 7 : 49 p.m. <br /> Paul Harrington, Community Development Coordinator, reported that <br /> Auto Central , 2975 Highway 10 had made application for a Conditional Use <br /> 0 Permit to allow the operation of a minor auto repair business at their <br /> existing facility.
