111Mounds View City Council Page Four <br /> 1 Regular Meeting July 11, 1994 <br /> E. Consideration of Contract with SEH for Storm Water Management <br /> Permitting Policy_ <br /> Samantha Orduno, City Administrator, reported that Rocky Keene, <br /> SEH, presented a schedule for assuming the permitting authority of <br /> surface water issues to Council at their July 6, 1994 Work Session. <br /> Orduno stated that the presentation included the necessary steps to <br /> be taken to accomplish this policy accompanied by a fee schedule for <br /> performing those tasks. Orduno explained that one of the tasks to <br /> be performed is to ensure that the current plan is in compliance <br /> with all laws and regulations of the Wetland Conservation Act. <br /> Councilmember Trude stated that at the Work Session it was discussed <br /> to have the City bring the ordinances up to date and she didn't <br /> realize that this meant that the City would rush into the permitting <br /> process. Councilmember Trude raised some concerns regarding this <br /> issue, i.e. , does the City have adequate staff to complete the <br /> process and also the fact the the City has no engineer. Trude <br /> stated that this would require that the City have the consulting <br /> engineer involved with each permit when the Rice Creek Watershed <br /> District has an engineer which would be covered by the Rice Creek <br /> Watershed taxing district. <br /> • Mayor Linke stated that the City's wetland ordinance is more strict <br /> than that of Rice Creek Watershed District. Mayor Linke stated taht <br /> now the resident or developer has to go through the same process <br /> twice, once with the City and once with Rice Creek Watershed <br /> District. <br /> Councilmember Trude asked if the City requires soil borings. <br /> Mayor Linke responded that the soil borings are done by the <br /> developer and all data is provided to the City's consultant. Mayor <br /> Linke stated that he is not aware of any case where a resident has <br /> - -had--to- do-soil---borings-. - The contractor normally- would--do--the-soil--- <br /> boring because the contractor would have to find out what the <br /> footings are being put on. <br /> Councilmember Trude questioned if this would add additional stress <br /> to the staff by having them do processes that they don't do now. <br /> Trude stated she was concerned if staff could adequately handle this <br /> permitting policy. Trude stated that she understood the City was <br /> talking about SEH bringing ordinances up to date, but didn't know <br /> that the City was taking over permitting. Trude also expressed <br /> concern that there was an environmental issue conflict with <br /> development goals. Trude stated that the City would not be as <br /> objective as Rice Creek Watershed District. Trude stated that she <br /> 1111 would like more public input. Trude also stated that the City could <br /> deny a permit in a wetland and the City would end up defending <br /> themself in court. <br />
