Mounds View City Council Page Eight <br /> Regular Meeting October 10, 1994 <br /> 1111 <br /> Councilmember Blanchard asked if contingencies could be listed would that <br /> help the approval of the preliminary plat. <br /> Councilmember Quick stated that contingencies help some, however, until <br /> it was approved there would be no money transactions and when there is <br /> money transactions it becomes binding. <br /> Mayor Linke stated that approving the preliminary plat at this time it <br /> will not delay the entire project. If the preliminary plat is delayed it <br /> could be a month to six weeks regarding the construction period. Mayor <br /> Linke stated that, in his opinion, he sees no problem with the approval <br /> of the preliminary plat at this time. <br /> Councilmember Trude stated contingencies that could be placed on the <br /> preliminary plat. These contingencies could be; 1) Outlot A as shown on <br /> the proposed plat shall be deeded to the City until such time that the <br /> property to the immediate south of the Outlot is developed, 2) storm <br /> water ponding on the proposed plat shall be provided per direction of the <br /> Consulting Engineer, 3) water main issue shall be provided per direction <br /> of the Public Works Director and City Engineer. <br /> Harrington brought up that the fourth contingency should be that the rate <br /> • of flow cannot increase. <br /> John Wilcek stated that MnDOT has already approved the preliminary plat. <br /> Councilmember Trude stated that the final contingency should be the <br /> satisfactory resolution of additional issues that may arise during <br /> consultations with City staff. <br /> Councilmember Quick asked Paul Harrington, Community Development <br /> Coordinator and Samantha Orduno, City Administrator, if they were <br /> satisfied with the contingencies that had been added. <br /> Both theCityAdministrator and the Community- Development Coordinator <br /> responded in the affirmative. <br /> MOTION/SECOND: Trude/Blanchard to Adopt Resolution No. 4639 Approving <br /> the Preliminary Plat of. Sherwood Estates for Citywide Developers with the <br /> Following Contingencies: <br /> 1) Outlot A as shown on the proposed plat shall be deeded to the City <br /> until such time that the property to the immediate south of the Outlot is <br /> developed, 2) storm water ponding on the proposed plat shall be provided <br /> per direction of the Consulting Engineer, 3) water main issue shall be <br /> provided per direction of the Public Works Director and City Engineer, 4) <br /> MnDOT rate of flow cannot increase and 5) satisfactory resolution of <br /> additional issues that may arise during consultations with City staff. <br /> 4111 VOTE: 5 ayes 0 nays Motion Carried <br />
