Planning Case VR02-009, CU02-001 <br /> <br />Planner Atkinson indicated the applicant has requested a variance from the minimum lot area <br />required for auto repair and a conditional use permit to allow auto repair in a B-3 zoning district. <br />He then indicated that the Code requires 22,500 square feet and this lot is 20,081 square feet <br />based on information from Ramsey County. He further indicated the applicant would need a <br />variance of 2,419 square feet. <br /> <br />Planner Atkinson indicated the criteria to be met are found in the staff report. He also noted a <br />letter was in the packet from the applicant to address the criteria. <br /> <br />Planner Atkinson indicated the conditional use permit was contingent upon the variance being <br />approved. He then said the conditional use permit would allow the auto repair facility and <br />allows the City to set requirements to protect the surrounding neighborhood. <br /> <br />Planner Atkinson indicated that Staff was seeking direction as to how to proceed with the <br />request. He then said that if the variance is denied, then Staff would recommend the Planning <br />Commission recommend to the City Council denial of the conditional use permit. <br /> <br />Commissioner Song asked if the car wash business was being turned into auto repair. <br /> <br />Planner Atkinson indicated that three of the seven car washing bays were being converted to auto <br />repair. <br /> <br />Commissioner Song asked if Staff had heard any feedback from the neighboring property <br />owners. <br /> <br />Planner Atkinson indicated that R.J. Riches Restaurant had not sent in a response but Staff had <br />received a letter from the Days Inn indicating they were not opposed to the variance provided <br />there were no junk cars sitting out in front that would detract from their business. He then <br />indicated he had spoken to the current property owner who had said R.J. Riches did not have an <br />issue with the variance. <br /> <br />Nick Boosalis indicated he knows Louis at R.J. Riches and his only concern was that no junk <br />cars would be sitting outside. He then commented that R.J. Riches saw it as a way of enhancing <br />his business because those waiting for auto repair could come over for food or coffee. <br /> <br />Chair Stevenson opened the public hearing at 7:06 p.m. <br /> <br />Commissioner Scotch indicated the new business owner has been in business for a long time. <br />
