Mounds View Planning Commission June 20, 2001 <br />Regular Meeting Page 5 <br />________________________________________________________________________ <br /> <br />Planner Atkinson noted the six (6) foot fence would be located around the entire property and <br />indicated the bracketed area on the drawing is where the four (4) foot requirement is located. <br /> <br />Chair Stevenson noted there are several instances where corner lots do have six (6) foot fences to <br />the side of the residence which fronts on one of the streets. He then noted that the circumstances <br />of the corner lot are difficult, as it appears there is street frontage as defined by City Code but the <br />resident treats it as a sideyard. <br /> <br />Commissioner Johnson indicated he would call it the sideyard of the residence. He then noted <br />that the Silver Lake Road development has six (6) foot fences. <br /> <br />Planner Atkinson noted the City is dealing with a technicality, as it is a front yard based on City <br />code. <br /> <br />Commissioner Kaden asked what type of fence Mr. VandenEinde intended to use. <br /> <br />Mr. VandenEinde noted the fence would be located around the property he considers to be his <br />side and backyards. He noted the reason for the request is that the four (4) foot height is not <br />sufficient to contain his twin daughters due to the two foot grade change on the Groveland side. <br /> <br />Chair Stevenson noted he could sit at his kitchen counter and see into Mr. VandenEinde’s <br />backyard and noted there is definitely a grade change. <br /> <br />Mr. VandenEinde noted there is a line of trees that the fence would need to be inside of so the <br />roots can be avoided when constructing the fence. He then noted that he should be well off the <br />property line with his fence location. <br /> <br />Mr. VandenEinde noted he intended to use shadowbox cedar boards to match the fence of his <br />neighbor. <br /> <br />Chair Stevenson inquired as to the Groveland right of way requirement and noted that the fence <br />would need to be located inside of that. <br /> <br />Mr. VandenEinde indicated he was told that his property line would be located thirty (30) feet <br />from the center of the road. <br /> <br />Chair Stevenson opened the public hearing at 7:33 p.m. <br /> <br />Chair Stevenson closed the public hearing at 7:33 p.m. <br /> <br />Chair Stevenson indicated he feels there is a hardship due to the difference in grade and noted he <br />had no problem granting the variance requested. <br /> <br />Commissioner Johnson indicated he would like to direct Staff to draft a Resolution of approval <br />for action at the next meeting.
