MOUNDS VIEW PLANNING COMMISSION -2- September 26, 1973 <br />A variance for a side yard setback for a driveway was presented by James <br />Kositza, 2800 /import, Lot 1, Block 2, Eigenheor 4th Addition. Mr. Kositze's <br />neighbor on the garage side, Mr. Warren Pabst, appeared also. A letter was <br />read to the Commission from Mr.Pabst's attorney regarding the attorney's legal <br />opinion as to the effects thin driveway would have on Mr.Pabet's property. <br />The cement slab has already been poured and is 6• from the lot line. It was <br />red tagged earlier by the Village for being in violation of our ordinance. <br />Mr. Kozitza's intentions are to use this slab as a parking seta for his <br />tractor. He wants to erect a opaque fence 2" from the lot line to screen <br />this tractor from Mr. Pabst's property. Mr, Pabst feels this cement slab <br />right next to the lot line will be a detriment to his property, <br />MSP (Glazer /Shelqulst) recommended that unless Mr. Kozitza and Mr. Pabet <br />could come to some mutually satisfactory agreement, the Planning Commission <br />withholds or eenios Mr. Kozitza'o request for this variance. 9 ayes, <br />MSP (Shelqulst, Feick) to amend Mr. Glazer's motion that a time limit for <br />a al'reaching this, agreement be limited to one month from tonight and futhnr, if <br />e' agreement ie';(rbaohed prior to next month's Planning Commission Meeting, the <br />Village Attorney provide us with a ruling as to whether this slab is a <br />driveway as defined in 40.05 (2) (d) (2) (p. 16) or "other* as defined in <br />40.03 5 (2) (b) (p. 11) of our Ordinance. 9 ayes. <br />John Kelnor, 7t45 Groveland Road, Lot l., Spring Lake Park Knolls requested <br />a Minor Subdivision (2 lots). <br />M3P (Glazer /Burgraff) to recommend approval of Mr. Kelner's request for <br />'a Minor subdivisioa of Lot 1; Spring Lake Park Knolls. <br />Mr. Bill Edds of Programmed Land asked for a Mayor Subdivisioft of the land <br />located to the east of Highway 10 and north of Highway Avenue. This parcel <br />contains 11.37 aeres. Mention was made to Mr. Edds of the law requiring <br />land or cash donation, to the municipality in subdivisions of over 5 acres. <br />This will be brought up again when Mr. Edds comes in with a preliminary plat <br />of the above designated land. Tonlght, Mr. Edds showed uu a sketch plan of <br />'bat his intentions are on the land is queztion and asked oar, assistance <br />before he went ahead with his preliminary plat. A Standard Gas Station and <br />a Country Kitchen are now located on the south portion of this property. <br />Mr. Ode said he had some plans for e. Mollonald's in one Election of the <br />Subdivision, and a motel with 10C units for another. A third area will be <br />left open for future development. The main discueslon centered on existing <br />road easements and proposed road easements. His sketch indicated a fully <br />contained area with traffic movement tota iy confined within its boundaries. <br />Questions arose as to what would be eventually developed Borth of his subdivision <br />and difficulties that development may have in traffic congestion. <br />MSP (Buraeistee /Falck) to recommend a vacation of the easement in the <br />Northeast corner 210' strip on the East'side'of proposed Block 2, Lot 3 but <br />maintain the easement on the 180' curve on the East side; vacate easement on <br />the East side of the Southeast corner of 210', Block 2, Lot 2, and Vacate the <br />South easement of Block 2, Lot 2, of 282.70', have the CO' road go through <br />the lower i/3 part of the Subdivision as indicated in the Preliminary Sketch Plan. <br />wee. <br />
