August 23, 1978 <br />~ 7-11 FOOD STORE - VARIANCE REQUEST ANO CONDITIONAL USE FERSdIT, <br />g Official Rose stated that he had received a ca11 from David Schaak at 4:10 PM, <br />saying that he and his staff had noL been eble to get tngether and prepar? for the <br />meeting and that they would not be attending the meeting, Official Rose stated <br />that he explained to Mr, Schaak that if he did not appear before the Planning <br />Comnission that evening that he would be waiving his right to appear before them <br />and give them his input regarding the request and that 1t was the Plannin9 <br />Commissions right to make a recommendation to the Council, even if 7-I1 did not <br />appear, and that h1r, Schaak had stated that he understood and agreed to giving <br />up his right to appear before the Planning Comnission. <br />Officiai Rose reported that a hearing is scheduled at the September 25 City Council <br />meeting on the issue. Ne added that Attorney Meyers had concurred wfth hlrn on 7-11 <br />givir~y up their right to appear berore the P'lanning Commission. <br />Officiat Rose explained that at the February 27, 1978 Council meeting 7-11 hiad been <br />instructed to submit a report with tnformatian thr Cauncil wa, requesting, and that <br />when Staff reviewed tt~e report, they did noC feel it was adequate and ordered an <br />impact study, and that,MldwAst Planning's conclusion was that the request from <br />7-]1 6e denied for many reasons.
