<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 102-84 <br />PAGE TWO OF THREE <br /> <br />c) Per the requirements of Chapter 49.07, Subd. 4(a), <br />notification to the Commissioner of Natural Resources <br />should be made prior to submittal to the Council; and <br /> <br />WHEREAS, the sanitary sewer system proposed appears to meet <br />the City of Mounds View criteria~ and <br /> <br />WHEREAS, easements for drainage purposes shall be provided <br />and recorded per the plans submitted~ and <br /> <br />WHEREAS, the Fire Chief has reviewed this development <br />proposal for conformity with all applicable fire codes and finds <br />it to be in conformity with all fire codes reviewed; and <br /> <br />WHEREAS, the Rice Creek Watershed District has reviewed <br />this proposal and finds it to be in conformance will all Codes and <br />regulations of the Rice Creek Watershed District; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br />Planning Commission recommends approval of the request by <br />Christopher Companies of the following: <br /> <br />1) A major subdivision combining 10 lots into 1 lot. <br /> <br />2) A conditional use permit allowing the extraction of <br />materials within the flood plain zoning district. <br /> <br />3) A flood plain use permit which allows the excavation/ <br />placement of fill within the flood plain zoning <br />district. <br /> <br />4) Vacation of the existing 10 foot utility and drainage <br />easement between existing lots 7 and 8. <br /> <br />5) Vacation of the existing 25 drainage easements (Document <br />No. 163496) between existing lots 4 and 5 by relocating <br />and expanding the easement north of its existing loca- <br />tion to the detention basin area. All open areas east <br />and west of the garages located on the north end of the <br />property, and all property to a distance of 200 feet <br />north of the northern most surface of the garages <br />located along the north end of this development in <br />addition to the exsting 17.5 foot easement along the <br />west property line shall be easemented. (See map for <br />easement location.) <br /> <br />6) Vacation of the existing St. Stephen Street right-of-way <br />from Bronson Drive to County Road I conditioned upon <br />the retention of storm water drainage/storage easement <br />should it be determined to be necessary for future storm <br />water drainage/storage by the Storm Water Management <br />Plan. The existing right-of-way west of the center line <br />shall revert to and become part of the Nordling Terrace <br />plat and the existing right-of-way east of the center <br />
