<br />. <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 157-86 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RECOMMENDATION TO THE CITY COUNCIL REGARDING PLANNING CASE <br />NO. 186-86, MARCELLA RYBAK (STANLEY FISHER ADDITION), <br />MAJOR SUBDIVISION (GROVELAND ROAD AND ARDAN AVENUE) <br /> <br />WHEREAS, Marcella Rybak has requested City approval <br />of a major subdivision; and <br /> <br />WHEREAS, the request is to subdivide the property <br />into 10 lots and to grant a wetland alteration permit to <br />fill a portion of the wetland; and <br /> <br />WHEREAS, the preliminary plat satisfies all City Code <br />requirements including Chapters 40, 42, 48, 49, 49A and <br />State Statutes; and <br /> <br />WHEREAS, the development will be reviewed and <br />approved by the Rice Creek Watershed District (RCWD) prior <br />to construction; and <br /> <br />WHEREAS, Ramsey Soil and Water Conservation District <br />(RSWCD) located the wetland on the subdivision in the summer <br />of 1986; and <br /> <br />WHEREAS, the wetland located by RSWCD is smaller than <br />the wetland zoning district map in the City Code; and <br /> <br />WHEREAS, City Code Chapter 48.02 allows the wetland <br />zoning district map to be amended by four-fifths affirmative <br />vote of the City Council; and <br /> <br />WHEREAS, City Code Chapter 48.02, Subd. 5(c) states <br />that all structures shall be set back at least 100 feet from <br />the wetland; and <br /> <br />WHEREAS, City Code Chapter 48.06, Subd. 3(a) states <br />that filling may be allowed when necessary for the use of <br />property but only when it will not have a substantially or <br />significantly adverse effect upon th ecological and <br />hydrological characteristics of the wetland; and <br /> <br />WHEREAS, the existing wetland's size is 1.1 acres; <br /> <br />and <br /> <br />WHEREAS, the fill will be triangular in shape and its <br />size will be a maximum of 0.04 acres with a maximum depth of <br />1/2 foot; and <br />
