<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 157-86 <br />PAGE TWO OF TWO <br /> <br />WHEREAS, a house cannot be constructed on Lot 9 <br />without installing the fill; and <br /> <br />WHEREAS, the fill will not have a substantial or <br />significant effect upon the ecology or hyrdology of the <br />wetland; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br />Planning Commission recommends approval of the request by <br />Marcella Rybak to subdivide the land as presented in the <br />drawings received by the City on March 12, 1986, contingent <br />on the following: <br /> <br />1. Approval by Rice Creek Watershed Distrct. <br />2. The work shall begin within 12 months from the <br />date of issuance of the permit per City Code <br />Chapter 48.06, Subd. D(5). <br />3. The City's receipt of the drainage easement or <br />title for Outlot A free and clear of any <br />encumbrances on title or taxes per City Code <br />Chapter 48.08, Subd. 2. <br /> <br />BE IT FURTHER RESOLVED that the Mounds View Planning <br />Commission recommends ammending the wetland zoning district <br />map per attachment #l; <br /> <br />BE IT FURTHER RESOLVED that the Mounds View Planning <br />Commission recommends granting a wetland alteration permit <br />to fill the wetland a maximum of 0.04 acres to a maximum <br />depth of 1/2 foot; <br /> <br />BE IT FINALLY RESOLVED that the Mounds View Planning <br />Commission directs staff to forward this resolution to the <br />City Council prior to approval of the minutes. <br /> <br />Adopted this 2nd day of April, 1986. <br /> <br />ATTEST: <br /> <br /> <br />(SEAL) <br /> <br />~ JIId- <br /> <br />~rector of Public Works/ <br />Community Development <br />
