<br />. <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING CO~~ISSION <br />RESOLUTION NO. 250-89 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A PLANNED UNIT <br />DEVELOPMENT AND TWO CONDITIONAL USE PERMITS FOR EVEREST <br />DEVELOPMENT'S TACO BELL AND KENTUCKY FRIED CHICKEN <br />RESTAURANTS, PLANNING CASE NOS. 264-89 AND 265-89 <br /> <br />WHEREAS, Everest Development has requested approval of a <br />Planned Unlt Development and two conditlonal use permlts to allow <br />Taco Bell and Kentucky Fried Chlcken Restaurants at the property <br />located at the southeast corner of Hlghway 10 and Quincy Street, <br />legally known as Lot 1, Block 5, Mounds View Business Park; and <br /> <br />WHEREAS, the Plannlng Commission has reviewed the <br />applicant's request for a planned unit development and <br />condItlonal use permIts and determines that lt is in conformance <br />wlth Chapters 40, 48, 49 and 49A of the City Code; and <br /> <br />WHEREAS, the Plannlng Commlssion has determined a flndlng <br />of fact that the proposed planned unit development/condltIonal <br />use permIt meets the followlng criterla: <br /> <br />a. The use wlll not create an exceSSlve burden on <br />eXIstlng parks, schools, streets and other public <br />facilitles and utilltles which serve or are proposed <br />to serve the area. <br /> <br />b. The use will be sufflciently compatlble or separated <br />by dlstance or screenlng from adjacent residentially <br />zoned or used land so that eXlsting homes wlll not be <br />depreclated in value and there wlll be no deterrance <br />to development of vacant land. <br /> <br />c. The structure and slte shall have an appearance that <br />will not have an adverse effect upon adjacent <br />resldentlal propertles. <br /> <br />d. The use, ln the oplnion of the City Council, is <br />reasonably related to the overall needs of the City <br />and to the existlng land use. <br /> <br />e. The use is consistant wlth the purposes of the Zoning <br />Code and the purposes of the zoning distrlct in which <br />the applicant intends to locate the proposed use. <br /> <br />f. The use is not in confllct with the Comprehenslve Plan <br />of the City. <br /> <br />g. The use WIll not cause trafflc hazards or congestlon. <br />
